The small royalty checks I get at this point have come from a South Charleston, WV address, my 2021 1099 came from Bolivar, OH and I think the 2022 1099 came from Louisville OH. </span></p>

<p>Example my well still looks to be producing on average of 1500 MCF of gas yearly, but they stopped running the pump jack and haven't shown any oil produced since 2019, was producing between 100-200 barrels a year. </p>

<p>We had a lease with Gulf Port Energy on our land (20 acres) back in 2011 and no drilling ever occurred, and never happened for years. We did get our bonus money and was waiting for them to drill and hoping for royalties, someday. Then Chesapeake took over and we thought they would lease with us and it never happened. We called, but never got a lease, but, they said they would re-lease just before they were ready to drill, that didn't happen. Then they sold to Encino Energy, and they started drilling the Deucker well, in Harrison County Ohio, that we are in. We were waiting to hear from them because we know they are drilling, and figured we would get a lease, as time goes on. Well, our neighbors said the royalty checks are looking pretty good. We know they took out a permit and that they would be drilling under us to the road where our property ends. No question, we are in the pool. I called Encino Energy and talked to the land man. He said there was some confusion, there were some old leases and that they would get back with me when they could get better clarification on what is going on. A couple months go by and a few days ago we just get a large check in the mail from Encino Energy. I call the land man and ask why we received a check because we don't have a lease agreement? He said there is an old lease from 1973 (48 years old) that they are going to adhere to , which is not a very good lease for us.</p>
<p>My question is, can they do that to us or should there be a new lease with us?</p>

<p class="article__paragraph--left" id="SIV5PZDPWVGCBHDSASXAOUDOYE">The court on Oct. 30 agreed to decide whether tactics used by gas extractors to obtain leases fall under the Unfair Trade Practices and Consumer Protection Law and if antitrust remedies can be pursued under that statue.</p>
<p class="article__paragraph--left" id="NFE5SPTPPVHBBPNCDJHPTTWD2U"><a href="https://www.pennlive.com/news/2015/12/ag_kane_sues_gas_producer_for.html" target="_blank" rel="noopener">In the suit filed in 2015 in Bradford County on behalf of private landowners,</a> then-Attorney General Kathleen G. Kane accused gas extractors of using deceptive, misleading and unfair tactics to obtain leases.</p>

<p class="article__paragraph--left" id="XXU7DVMD6ZHN3LY4CFA6C2VQCQ"><a href="https://www.pennlive.com/midstate/2014/02/bradford_county_farmer_gets_ga.html" target="_blank" rel="noopener">A farmer reported getting a $1.10 check</a> in 2014 for gas taken from two well pads on his land in the Sayre area.</p>
<p class="article__paragraph--left" id="W5JOMY6YWNFHXEENIYHQH5FMUA">“Nothing has really changed,” said Rex Kingsley who has six wells on his Bradford County properties. “They’re still taking large deductions,” he said.</p>
<p class="article__paragraph--left" id="7ZRHPLSCEVBDXDIB3HQ2UDJMLM"><a href="https://www.pennlive.com/news/2016/05/gas_drillers_accuse_kane_of_tr_1.html" target="_blank" rel="noopener">In fighting the suit, Chesapeake Energy Corp.</a>, Anadarko Petroleum Corp. and their affiliates claim the Unfair Trade Practices and Consumer Protection Law does not apply to the leases.</p>
<p class="article__paragraph--left" id="QQNXB4R4MBCMHKVV2A5VILR3SA">But Lycoming County Senior Judge Kenneth D. Brown, specially assigned in Bradford County, ruled it did.</p>

<p class="article__paragraph--left" id="D5DZ4SQ27RHERN44IIOLUI6YKY">In a March 15 decision with one partial dissent, Commonwealth Court found gas leases were sales and thus fell under the consumer law. That statute provides for civil penalties of up to $1 million for each violation.</p>
<p class="article__paragraph--left" id="2DSOCXIH3VGIZCFRFFEMUMV5HA">The Supreme Court has agreed to hear Chesapeake’s and Anadarko’s appeal of that decision.</p>
<p class="article__paragraph--left" id="QG3IMAYI2VATJCP2HGFV5VC4CQ">“These companies have been trying to utilize the attorney general’s office as a scapegoat from the beginning,” Attorney General Josh Shapiro said Friday. “At any time, they could stop these proceedings, make these landowners whole and keep the promises they made. Instead, they continue finger-pointing. Our office continues to fight for these landowners and we have no plans of stopping.”</p>
<p class="article__paragraph--left" id="5JRD4S5V5JD5RA74X4N3ZJGALE">It is not the only litigation regarding the calculation of royalty payments.</p>
<p class="article__paragraph--left" id="QQMSO6V7SJAC3OKFTIOSAKT23Y">A number of property owners in 2013 sued Chesapeake in U.S. Middle District Court contending it is improper to deduct from royalties the cost of such things as dehydration and compression.</p>
