chk showed up on my farm today and started constuction on a pad and water impoundment. gave us no notice...no surface agreement was signed....they are taking 12 to fifteen acres of our crop field..cutting trees..putting in roads etc. i had no idea they were starting. they gave us a surface agreement to look at...never came back and just showed up digging. i went out this morning...shut them down...after i left they started again. we have an old o&g lease from 2005...they say they can do whatever they want...any advice mark

i asked if the landowner would be notified as to when they would begin building and the way i understood it is, once the lease is signed they do not have to tell you when they are coming out. you could be getting up for breakfast one day and there they are. SURPRISE!!!
chesapeake is all about business and has no consideration for people's feelings. even the cable guy calls before he comes to the house.
do you have the lease from 2005? Look for a clause titled "Sitting/Spud Payment." i dont know how specific the language was in 2005 compared to 2011. my lease states that - Lessee shall pay Lessor in consideration for damages to leased premises the sum of ($$$$ here it states amount of payment) prior to the commencement of drilling of any well on the leased premises, such payment to be considered a "pad" payment.
i would get this documented by use of a camera/camcorder so you have proof of damages to your property. get pictures of the trees. did you get a soil and water sample, i would do that too.
get an attorney with experience with these oil companies to help you. better safe then sorry!

Are all gas companies like Chesapeake? What about Shell, Chevron, CNX Gas, EQT and others? How are they to work with?
Permalink Reply by Mike h on December 9, 2011 at 3:32pm The SURE group lease stipulates that they have to work with the lessor for siting and has specifics about what they (Rex) or subsequent lessees have to do for siting a pad, etc.
and further to my post below...EQT has been very forthcoming and open with their communications now that we have got rid of the landmen and others in the early days of this Marcellus rush. It seems that possibly these bad experiences maybe were caused by dealing with a third party rather then dealing directly with the big O&G's...just MHO...

I have wells in Greene Cty, PA too. I was born there...love those rolling green hills. The name is so appropriate and love the gas in those hills too!! Like your response...very positive...there must be more then meets the eye with these experiences that these people are having...hmmmmmmmmm
