Timber Compensation for Right of Way Agreement

 What considerations have been asked for in regards to timber that

will be lost in the placement of said right of way ?

  We normally select cut our timber every 20-25 years and once

the pipeline goes thru all future timber growth is gone.

 How have some of you handled this in your agreements?

We are getting a pipeline as well as a road.  You have several options.  First you get surface damages in $.  When they clear cut land you will never in your lifetime reap any timber harvest this is what surface damage is.  The timber is another issue.  First they will send in a forrester to assess the $ value of the timber.  you may have the option of having it cut yourself.  Our contract states that they will cut the timber, we can sell the marketable ourselves but they are giving us twice the value of the timber.  We will not sell our timber, we will keep what we can use the the timber that is unmarketable we will heat our house with.  The timber crew has agreed to haul it to one location and seperate the marketable from the wood that we will burn in our woodstove.  Make sure your contract states that they have to crown, ditch, install pipe and use what ever possible to prevent erosion and have proper drainage. Some companies pay by the foot and some pay by the acreage and make sure it is explicite on the width.  Good Luck
