Walker v Nau: supreme court case decided in favor of mineral rights owners!!!

Check out the Ohio Supreme Court website to read the decisions. Both Walker v Nau & Corban v Chesapeake have been decided in favor of the mineral rights owners. There is no automatic vesting. Hurray!!!

Does anyone know if this issue is over now? can mineral owners contact oil companies now?

My husbands family was contacted about their great grandparents mineral rights about 4 years ago. However, they made sure that there was not time to respond before the deadline. The notice about their mineral rights was put in the Belmont County newspaper but we are in Utah so didn't see the notice. Anyway, all of the family did respond but it wasn't before the deadline. Even the cousin in Ohio went right to a lawyer the very day she got her notice to claim her mineral rights but it wasn't filed until the next day. That made it one day late. How much of a difference do you think a late filing will make when we go to court?

Did the surface owners attempt to send registered mail to any of the heirs?

All of the cousins did get a registered letter. BUT.... they made sure that we couldn't reply in time for the deadline. We had one day to respond and file a claim. I hope when we go to court that all that will be taken into account. Bonnie
