Was wondering if anyone has been approached by Rex to sign a pipe line right of way lease for the Renick well in Center Twp. I've been approached already but I haven't signed it yet due to the fact that they are very vague with the lease and paying a flat rate of $25 per ft. which they are splitting between damages and the pipe itself. I'm trying to get them to give me a price per inch per linear ft payment but not sure what the going rate is. Was also wondering if this pipe line is going to connect with the line EdgeMark is putting in that crosses Rt 308. Any info would be great. Thanks!

4 years and royalties sounds good to me.

You don't get royalties for a temp water line right of way. Anyway, the wording would allow them to run a line anywhere, even on my property next to the one we were negotiating on. Go figure. LOL.

Yes Jon, They pay by the lineal foot and were very agreeable when I corrected their short changing me in this area. I had agreed to a simple 5.00 dollar a  foot for an over the ground water line to travel down a previous r/w. Then Rex came back with they would need a bulldozer to knock down trees and clear out bushes etc.. And then they said they want something in writing granting that temporary r/w to become a permanent r/w at their discretion. It seemed like every time we would verbally agree on something then Rex would come back and demand more. They appear to be trying to make it look like they were doing me a favor instead of vise a versa . I decided they were wasting my time by keep asking for more and more. They got too greedy with MY land. Decided not to sign written agreement because they gained too much at my expense. They took kindness for weakness and tried to exploit me. Ain't happening on my watch! IMHO.

You are absolutely correct Robert.

They start off dangling $$$ in front of people acting like they are doing you a big favor by you allowing them to use your land. 

Unfortunately a lot of people bite on the $$ and do not look hard enough at the possible negative impacts on their land. And if you start to question it they downplay the whole thing and make it sound like they are just going to lay a very large garden hose across your property. Rarely is it that simple.

Wish more people did, would be better for us all. 

Thanks FairMktValue, People just need to read GMS (with a grain of salt) until they learn who gives good advice and who may have an agenda and THEN talk to your neighbors. I would also note that the more you learn the more you can watch out for "traps". My land agent was the nicest guy you could meet( even brought coffee for me),but business is business and you must go by the contract wording not the verbal assurances. All the people on GMS and my area neighbors were all willing to talk and help and I thank them all. I'm a little more wiser now and more confident if it ever comes around again. I'm glad we have this Forum. 

Did I mention that twice when the land agent called he wanted to bring the Notary that happened to be with him that day, so we could get all this "stuff" resolved and over with?  hahahahaha. That went over like a lead balloon!

Your above paragraph pretty much says it all.

It does not take all that long to "learn" at least enough to know what to watch out for and may need to do a bit more "learning" on.

Leases and ROW agreement are "binding legal contracts". It drives me crazy when people tell me "Ya but the landman said......"

And I ask "What does the contract say?"

"I dunno"

'Well ya think ya might just want to read a paragraph or two?"

FairMktValue  (FMV, if that's ok), I got another call from the land agent saying he would like to meet with me again. He blew me off the last meeting when I said "not interested" because of agreement wording. His message said he was too busy to show up but now he has time to talk some more. What do you think? Is his boss reading my comments and  sending him back? Is my property access looking better because my neighbors want more money? I'd like to hear your two cents if you have time. If not, that's ok too. Thanks either way big guy.  Bob A.
