Hi all,  It's been a while since I visited GMS.  My computer took a s*** and I lost my username and password.  Prior to that I got tired of 'watching for the water to boil'. 

For the last few days I've searched this site and others to find out what the status of the Buell well, Kenneth Buell, and the lawsuit.  All discussion seems to have stopped around the end of July 2012.  Was there an appeal?, was Judge Nutter's decision upheld?, was the well shut down?(apparently not), have the mineral rights been returned to Kenneth Buell via the Dormant Minerals Act?

My reason for asking is that we own 28+ acres 1/4 mile from the Buell well pad 180 degrees from the existing laterals and we have had offers from $3500. to $10,000./acre for our mineral rights. 

Thanks for any information anyone may have to share.

Ohio Supreme Court 

The Ohio Supreme Court accepted to hear a certification of state law questions from the United States District Court for the Southern District of Ohio in the case of Buell v. Chesapeake Exploration, L.L.C., a case which involves interpretation of the Ohio Dormant Mineral Act in effect from March 22, 1992 to June 30, 2006.  The Ohio Supreme Court will answer the two following certified questions:  "Is the recorded lease of a severed subsurface mineral estate a title transaction under the ODMA, Ohio Revised Code 5301.56(5)(3)(a)?  (2) Is the expiration of a recorded lease and the reversion of the rights granted under that lease a title transaction that restarts the twenty-year forfeiture clock under the ODMA at the time of the reversion?"
