Comment by Dan on March 27, 2013 at 10:22am HarcO, you're right that Wendt v Dickerson was a Tuscarawas County case, but it involved mineral interest in Harrison County. The way I stated it was confusing though. The case you cited was tried in Harrison and the mineral interest was also located there. I'm not sure where the mineral interest was located in the Walker v Noon case but it was tried in Noble County.

Comment by Dan on March 27, 2013 at 7:30am Another verdict was just handed down using the 1989 ODMTA to restore mineral rights to the surface owner. The judge in Noble County came down in the same way as the Harrison County Wendt v Dickerson case a month earlier. Discussion of the act and a copy of this new verdict can be found in this thread.
