A second wave of leasing activity is happening throughout Northeastern Pennsylvania.  If you leased your property in 2008 for a five year primary term, the lease will expire unless the Lessee has commenced drilling operations, declared your acreage in a unit, or extended the lease by other provisions.  If the current lease has an option to extend for an additional period of time, be certain that you are aware of the current expiration date and the terms required for the Lessee to exercise the extension option.  At the expiration date, it is the landowner’s burden to request a Surrender of Lease document to record in the Recorder of Deeds Office.  The Surrender document is important; it is notice that your property is not subject to an active lease, and is available for leasing.

Feel free to use the attached example as a request for your surrender.  Send to the Lessee of record - the Surrender Request via Certified Mail with return receipt requested and retain a copy of the letter, post office receipt and tracking number.

nothing like having knowledge and using reasonable fact based negotiating methods.

one thing though...you seem to be using a relative measure to gauge your success.

doing better than someone...anyone else is not my goal. getting a good lease with terms that address my own unique concerns about my property, and good financial terms that reflect a number of factors relating to the actual value of the mineral resource which i own...those are my goals in leasing.

but still in all, i have some unleased land yet in tioga county. i may give mr. gass a call when the time comes to see what value he may be able to bring to my leasing situation there.

 GS Gass definetly has his finger on the pulse of gas leasing in Tioga county and has a history with it also.

 WJ, in your area with a few different companys drilling I would think you have a good chance to sign a pretty good lease and the production is good in that area.

yes paleface, i think we'll be fine once swepi releases our neighbor later this year. like i said before, seneca already has the infrastructure to drill us.

biggest question is whether they have much leasing budget for this year.

ok, you want to know what companies are leasing in my area.

do you mean in covington? because im not sure if any are currently, maybe seneca, but i havent talked to them in a while.

but if you mean where i live, which is bradford county, then i'm not sure where to start.

chk, and cog are leasing within their areas of operations. swn may still be leasing on a limited basis in their areas. citrus will take leases in their area.

i'm not sure if williams is leasing or not, but i would imagine they are depending on what you have.

hess is not, i think they know that they got burned the last time and missed the boat on the best areas.

range left for southwestern pa a long time ago and are just doing working interests with the mineral leases that they already hold.

fortuna is drilling. im not sure that they have enough results to determine which additional lands they might want yet.

chief is busy getting all of their leases hbp now, so probably not much leasing with them.

there's other companies, but you get the picture.

i guess the other thing to know about bradco is, that there isnt much unleased land left that the companies want. areas have pretty much been delineated and alot of the county is already in production.

Thanks for Posting as most leases in this area are about to expire. Seems like Shell is only focused in the NW quadrant of Tioga and letting the old East Resource Leases expire and AnaDarko is only up to Lycoming County

We used the form attached above with some modifications and sent certified registered mail with reciept to Shell after contacting them via phone to get whom to send it to.

Is there anything we need to do with the courthouse on the release or is that Shell that would handle after the letter sent ?  Thanks for any response to this question.

Once released the Land Man can see we are not leased and possible create new contract with other companies interested

The best scenario would be if Shell recorded the Surrender and sent you a copy of the recorded document.  Some exploration companies provide an unrecorded surrender, so you would need to place the surrender document on record in the Recorder of Deeds Office.  Unfortunately, there are several exploration companies that do nothing - if you are unsuccessful with your request, let me know.
