"it comes down to who owns the lease....the 5 shallow wells may have been part of a "sub lease". So one would have to read the lease to see who owns the deep rights. In any case....the landowner  should not sign any addendum for free."

Paul, much of what you said is good news from my perspective. First off, you're negotiating at a pretty high level with your current oil and gas company. Secondly, you've become savvy and probably have a pretty good idea of what would be fair to all concerned. Good luck to you.
