Pool declarations are usually toward the end of the process -- closer to when production starts.

declaration of pool would have to be part of the permit app. they would have to pool the acreage listed in the permit app.

thats what i was thinking Mike the permits were granted middle of last month so i should be able to go to courthouse now and get copy of pool declaration  right?  thanks  BILL

i was hopeing you were right Mike but i just got back from the courthouse and the pool declarations are not filed yet this is in WV   THANKS       WGA

what about lateral direction i should be able to get that from the dep you would think that would have to be part of the permit app.right?

Our initial permit was in July 2014.  Drilling started Sept 2014 and was completed Feb 2015.  Our pool unit was created in May 2015 and filed with the recorders office in June 2015  Our production started in May 2015.

Here in PA I have seen permitted wells with published well plats without defined units.  The units here in PA are defined by the declaration of Unit and are not linked to the permit.  In fact, units can be changed at any time - it has happened to me twice already.

Wow I always thought a pool declaration had to be filed in the courthouse before drilling starts thanks for the good info guys

WGA,

I have had this conversation with PA State Geologic Scientist I Robin Anthony here in Pittsburgh.  The "unit" boundaries shown on the permit well plats are "preliminary", "partial", "approximate".  I have looked at a lot of well plats and then the subsequent units that are formed and there is not much correlation.

Units are frequently "modified" (format at butler county recorder of deeds: x_Modification Document for example) even after division orders are issued and even after production has commenced.  Of course, if modified after the division orders have been issued, new division orders would be issued.

I think different drillers do things different as well.  In July it looks like our driller initialled filed a stratographic or test well permit and declared the 'unit' as the parcel of land the well pad was on.  Then in December a reissue was done making it an oil and gas well.  When that was done, a landowner listing was attached to the filing with our Division of Natural Resources and available on their website - but I did not see anything on our recorders site (courthouse) at that point.

In May they filed another permit to revise the unit and that looks like when the pool unit paperwork was done and subsequently filed in the recorders office.  We went into production at the end of May but have not seen any division orders yet.

I am in Ohio.
