Ray I think your living in a dream world. There are no leases with the stipulations you want.

Now with Oil and gas markets crashing it's a buyers market. If they make an offer it will be low ball and on their terms until oil prices rise again.

Typing in all caps online is yelling!  You do not need to yell.  

Also you have posted several times to get FREE gas in your lease.  You can not get free gas from most Marcellus/Utical wells. The gas is too wet and not appropriate to go directly to market/your house.  You can however have a clause that you get paid in lieu of free gas.  Only the individual who has the well on their property, in Ohio (I will not speak for other states.) can receive free gas or in lieu of payments.  

And in addition you should also have one or more specific statements about what causes the lease to end ... non-payment, no activity in five years and no renewal, non commercial production.  And if the lease has ended then the company must be required to file a statement in the county recorder's office marking said lease "released".  This is a trick many of the companies play to keep your land from being leased by anyone else.  The young people reviewing the documents in the recorders office see a lease and move on.  They have no idea there is no production, no well anymore even and that in reality the land is available for lease without that magic "released" document.  

We also did not allow our lease to be filed until payment was received.  I don't think it was in the wording of the document but it could be. Our groups attorney held both our copy and the companies copies until payment was received.  We had to go pick up our copy.  Another scam .. file the leases and basically hold them indefinitely without payment. No other company wants to deal with what looks like a leased property in the recorder's office.

You should also put in writing in the lease that you will be receiving a copy of the full  lease as well as the file copy (short version) that goes to recorders office with no details ... what good is a copy of only that. You could go to recorder's office and get that.  And you should have in your lease that you can request and will be provided with a new copy at any time you request it ... for your heirs who can't find it, house burns down, moved and lost it.  You get the idea.

BUT LAWYERS LOVE IT THEY ARE MAKING MILLIONS FROM THESE MORON GAS COMPANIES TRYING TO SCREW PEOPLE.

BACK IN THE 70'S THEY WOULD DRILL SURFACE CASING AND MOVE OFF THE LAND JUST TO KEEP THE LEASE. SOME TIMES THEY WOULD COME BACK SOME TIMES THEY TOOK THE INVESTMENT MONEY AND RAN.

YOU SEE THEY GET MONEY FROM INVESTORS UP FRONT THEN THEY SAY THEY ARE LEASING GROUND, THEN THEY RUN FOR THE 4 WINDS SO YOU CAN NOT FIND THEM WITH 10 OR 15 MILLION IN THERE POCKETS.

THEUSA COULD STOP THIS BUT THE LAWYERS DO NOT WANT THAT THE WANT THE LAW SUITS. I DO NOT TRUST A LAWYER, I HAD A BUDDY THAT WAS A LAWYER, HE TOLD ME HIS JOB IS TO KEEP YOU ON THE STRING AS LONG AS HE CAN, AND THE LAWYERS ARE LIKE THIEVES THEMSELF. THEY GET TOGETHER AND MAKE SURE THE LAW SUIT GOES AS LONG AS POSSIBLE SUCKING MONEY FROM YOUR POCKET. ( ALLWAYS REMEMBER LAWYERS JOBS ARE TO KEEP YOU IN COURT AND SUCK AS MUCH MONEY AS POSIBLE ) THEY DO NOT CARE IF YOUR RIGHT OR WRONG THEY GET PAID, JUST LIKE A WEATHER MAN. ( GOOD LUCK)

UPDATE: I called the Texas number back on the 1099 in the morning and got someone on the phone. I was told by the guy that the check was send out 2x but it was returned. I didn't get any notices in the mailbox.

Anyway the man said he would send a new check out shortly to my home address. If  check comes I will update.

Gosh, that's great!  I hope you get the money!

And of course if you do, it will be 2015 money.  

Seems to me they need to rescind the 1099s sent based on the checks you never received . . . . and send a new 1099 in 2016 for the check we all hope you are about to receive!!

well pricks never sent the check .

send them a certified letter that gives them 30 days to pay or demand release due to non payment. I did that (thru my attorney and got paid toot sweet. (not from this company)
