Lawsuits in Ohio and Supreme Court of Ohio regarding Mineral Rights Holders

We received a lease check from Hess Oil last year as a payment for a five-year lease. Now they are drilling, but we are not receiving a royalty check. We have been told the oil companies in Ohio are holding royalty checks for those who own mineral rights but do not own the surface land. We are told they are waiting to see who gets the money until the State of Ohio Supreme Court makes a decision on if the recipient will be the mineral rights owners or the land owners. Does anyone have further information on this? Here we are paying mineral rights taxes to Harrison County, yet we may not even get any money from our mineral rights! If you have information, we will be most appreciative.

Ahhh that would be (is?) such a beautiful thing.

Free enterprise in a rigged market ?

Got an Ad Valorem Clause in my lease but the best We could get was 7/8 of additional Ad Valorem Tax paid by lessee. Figured that was ok because royalties were more than 1/8. Also got that in ROW agreements but it's 100%.

Government is greedy so you have to protect yourself.

Thinking both the government and the industry myself.
Industry is greedy will pay the least possible. Government is greedy and will take even if you have no income They"ll just take what you have and sell it. By force.
Paul Butler,

Wanted to thank you kindly for posting within and addressing this discussion.

Sent you a friend request earlier and standing by for your response.

Paul Butler

I see you remain unresponsive to my 'friend request' and it puzzles me somewhat.

I also see (from your 'Profile' page here) that you're identifying yourself as a 'Gas Professional' with something like 30(+) years of experience.

Perhaps you're remaining unresponsive due to not wanting to appear to be in conflict with your profession (not wishing to present an apparent 'conflict of interest').

I'll keep the 'invitation' open (for awhile longer) as you may be / have been too busy to notice / respond.

BTW Mr. Butler, I see no 'Friends' at all listed on your 'Profile' page here on GMS.

On that basis I sense no offense on your behalf and would like you to also know there is none intended on mine.

Thank you for your 'friend accept' received a little earlier.

Above a link to a discussion posted circa September, 2014 regarding mineral rights, real estate taxes, ad valorem etc.

However no mention of simultaneous 'Forced Pooling' impact.

Good luck to all of us.

My husbands great grandparents owned the mineral rights in Belmont Co. The seven cousins would split the mineral right money. While I understand everyone who has a problem with paying the taxes while we have not. I find it very unfair that we were notified about the mineral rights the very day we had to reply and file. Even my husbands cousin in Belmont Co. only had time to get a lawyer but not file it in time. That is very unfair. Bonnie

Was it not in the local paper,I see a lot of these in the papers.I think they have a certain amount of times that they have to run it in the papers which is standard procedure

According to ORC 5301.56, you have at least 30 days after the notice is posted in the newspaper to respond to it.
