Every landowner oppose PA Senate Bill 744 regarding royalty owner taxation

Please join me in opposing PA Senate Bill 744.  Here is a link to the bill:

This bill is currently in committee.  It could emerge at any time.  The bill is a serious threat to the financial welfare of royalty owners all across Pennsylvania.  It seeks to countermand a decision of the Pennsylvania Supreme Court, very much to our disadvantage.

Gene Yaw, a sponsor of this bill, has made a serious mistake.

Well here is how the state eventually confiscates your land for taxes.

So this is talking about assessing what is still in the ground I assume? 

I also assume they will be changing the language so as to tax all natural gas, just not what is in the Marcellus.

I'll tell you the politicians are heating and stirring the pot to the point that folks may just decide that it is time to stand up to our gov't entities. 

Pa. had plans for a big windfall right away for money from the Marcellus.  All of a sudden the play moved to Ohio and then stalled due to the economy and an over glut of gas.  Now the state wants to maybe change HBP so that it is no longer perpetual.  This could open up a new round of leasing on land once held by a vertical well.  If that were to take place, the next step would be massive tax escalations to gain revenue from the bigger leases, or to tax people off of their property.  Of course the Utica , looks to be more valuable than once thought.  That adds even more feul to the fire.  (Yes, the pun was intended.)

I would think that a ruling changing the status of hbp would be ruled unconstitutional because of the takings clause. An oil lease that is changed probably violates contract law

 

PA Senate Bill 744 was proposed in the 2011-2012 Senate Session.

We are now in the 2013-2014 Senate Session.

Is the immediate spectre of the 2011-2012 Senate Session PA Senate Bill 744 still hanging over our heads?

Or, did it die a quiet death?

Or, is it festering away, only to rear its ugly head in the future?

It's the right question . . the pivotal question.

My take is this bill is ready to go and lying in wait for events to pave the way for its passage.  What those events will be I cannot tell you.

The astonishing aspect to me is that Republicans like Yaw have placed their names on a disaster like this.  Yaw is supposed to be pro-landowner.  This proposed legislation is anything but.

One final thought:

It's possible this bill is aimed, somehow, at the gas companies . . . . and that the harm which will come to us is merely collateral damage.  That's a guess.  I don't really know.

Regardless, if this ever became law, the financial consequences for landowners and royalty owners could be off the charts!!

Gene Yaw doesn't give a crap about anything but gas contributions and getting re-elected.

While I also have a low opinion of the tactics of some politicians, I don't think this proposal is "festering". The time frame puts it in the same pot as the impact fee debate (which was enacted and is now in force). Since the language directs the income to the local taxing authorities, which get the benefit of the impact fee, I take it more as an alternative which was discarded.

I have contacted my Senator who just happens to be my neighbor as well.

Said the bill number did not ring a bell and that if it was not passed by the end of 2012 it would have to be reintroduced for the new session. Asked the Senator to also check for the wording tacking it on to other pieces of pending legislation to see if they can sneak it through the back door so to speak...

Big government is the bottom line problem,they've squandered all the money they've already taken from us. Now they are looking for other ways to steal money from is. If they must steal they need to look at all the lost revenue from on line shopping first that would fairer than trying to tap us few landowners. I don't like any of it but they need to get off the landowners back !!!!

I can't imagine the larger population of the metropolitan centers of Pa. really care in the majority if the state owns the valuable royalty generating land or the current land owners.  Of course ,plenty of representatives will be at the future Sheriff's ales from wealthy investers and the gascos themselves.  If legislation creats another round of rewriting leases, I'd suggest you get the biggest bonus you can manage and invest it well.  Yes, royalties are important, but the percentage will only go so high and you may never live to enjoy them.
