<p><strong><span style="text-decoration: underline;">My view</span></strong>:</p>
<p>The problem with the argument that forced pooling already exists for deep formations such as the Utica is that is misleading -- the current old law speaks of a "pool" of free flowing oil and gas in conventional reservoirs produced by vertical drilling; therefore, it should not apply to unconventional horizontal shale drilling that requires fracture stimulation in order to produce hydrocarbons.<br/><br/><strong>See 22C-9-7:<br/><br/><a href="http://www.legis.state.wv.us/wvcode/ChapterEntire.cfm?chap=22c&art=9" rel="nofollow">http://www.legis.state.wv.us/wvcode/ChapterEntire.cfm?chap=22c&...</a></strong></p>

<p><b><strong>§22C-9-2. Definitions.</strong></b></p>
<p>(9) <strong>"Pool"</strong> means an underground accumulation of petroleum or gas in a single and separate natural reservoir (ordinarily a porous sandstone or limestone). <strong>It is characterized by a single natural-pressure system so that production of petroleum or gas from one part of the pool affects the reservoir pressure throughout its extent.</strong> A pool is bounded by geologic barriers in all directions, such as geologic structural conditions, impermeable strata, and water in the formations, so that <strong>it is effectively separated from any other pools that may be presented in the same district or on the same geologic structure;</strong></p>
<p><strong><span style="text-decoration: underline;">My conclusion</span></strong>:</p>
<p>The currently antiquated legislation regarding forced pooling only governs a <strong>"pocket"</strong> or <strong>"pool"</strong> of petroleum or gas -- a completely different animal than fracking and horizontal drilling. Hence, <strong>current legislation does NOT allow a company to force pool during unconventional Utica drilling.</strong> </p>
<p>Even if there was a current law to force pool the deep formations, new legislation should be to eliminate that rather than allow shallow forced pooling.</p>

Anyone in the Doddridge Co Area who is familiar with the construction status of the Kirk Pad, located off of Big Isaac Rd near Miletus? The pad entrance is the same for both John Davis North and the Kirk well pads. JDN (first well pad into the site) was completed nearly a month ago and I think there may be a rig on the well pad but construction on the Kirk pad seems to have all together stopped. Any info would be greatly appreciated.

<p>First and foremost the intent of my post is to circulate information for the Mineral Owner. Before I get too far off the mark, I am a relative "newbie" to this business, and really on the outside looking in so to speak, that's in all honestly and being forthright, However, I do have a lot of contacts and connections within the business. Recently I have had the pleasure of getting to know both the MO's and representatives of the OG Industry. I have also been involved in lease negotiations from the initial contact phase clear to the lease signings and getting the deal done!</p>
<p>Its always very interesting watching the negotiation, the MO asking for what they want, the counter offers from the OG Reps, to and fro. Sometimes it goes very well which is the case more often than not, but sometimes it doesnt, and understandably so! I think its very important for both parties to realize that each have their own lines drawn within the sand so to speak for reasons on both sides.</p>
<p>My background is within Law Enforcement for over 25 years, in a myriad of positions, but most notably as a Hostage Negotiator which relates me if you will to this business. When I reflect upon the LE negotiations and link them to the OG negotiations they are in themselves essentially the same process. Obviously the Hostage is now the O&G beneath the surface. The MO wants a ransom for the OG from the operator, not in a bad way of course because quite frankly they own the minerals anyways obviously. However, the negotiation process is no different than that of LE. </p>
<p>The point is for all sides to realize that in order to get the deal done both sides have to get what they each want. If "hardball" is played by either side then its likely not to result in a "freeing" of the O&G, which is certainly obvious. I can tell you all from years of negotiation experience its always best to protect your interest, establish a rapport with one another, be forthright, understand not only your own interest but that of the other side as well. It truly goes a very long way in getting a successful negotiation done. After all....isn't it simply all about getting it done!</p>
<p>So that you all know, I am simply a POC (point of contact). My mission is to bring sides together, relay information, act in behalf of (nothing contractual/or commitment/legal). I know people reading this will say "well you're not doing it for nothing" which in theory is true to a degree. I'm "old school" if people are so inclined to compensate me then so be it, if not, then I still get paid. How so you may ask? The answer is pretty simple...I got an education from the process, and I'm now subsequently more knowledgeable about the O&G business, which in itself will become valuable to me as I move forward in the business in an attempt to establish myself in time.</p>
<p>So.....if you're looking to lease, or if you have any interest in a MO holdings but have yet to make contact please contact me and I will do my best to make the negotiation process happen!</p>
