As a land and mineral owner in _____ County, WV, I am writing to
inform you of my opposition to any legislation, more specifically HB
2688, that supports and advances the practice of seizure of private
property in the form of 'unitization', 'lease integration', or 'forced
pooling' of my privately held mineral rights.

This bill is morally wrong and I'll tell you why I think so. If the
gas and oil interests are allowed to tell me they going to take
something that I own and they going to tell me what they going to pay
for it and I’m going to take it whether I like it or not --well I
consider that extortion.
And extortion would be a nice word for it. I think a more proper
descriptive would be thievery.

This Legislation proposed by Industry Lawyers would put in place a 5
person committee, to decided what 'Fair and Just' bonus payments and
royalty amounts will be paid to Land Mineral Owners.

That almost sounds like 'fair and balanced'. Somehow I don't feel
comforted by someone who has a financial interest in stealing my
rights to negotiate fairly. How can any legislator in this state of
West Virginia justify passing this bill?

I would deeply appreciate your response in how you are going to vote
for this bill. Yes or No and why if you care to expound upon this.

And I strongly ENCOURAGE any other mineral rights and property owners here in the state of WV to write their state senators regarding disapproval of this horrendous legislation.
Two Questions: One, does anyone know of a reasonably priced Attorney regarding separating surface land from mineral rights and re: Division Paperstag:gomarcellusshale.com,2015-01-14:2274639:Topic:6537052015-01-14T17:01:57.152ZTeri OHIOhttps://gomarcellusshale.com/profile/TeriOHIO

Hello everyone! I have two questions. I need your advise and opinions. We own property in Harrison County, OH. We are wanting to separate our surface land from the mineral rights and continue to own both. I am thinking along the lines of what one member: Ron Eiselstein wrote that it is good for lots of reasons to do this. Does anyone know of a decent attorney who understands how to do this for our properly and is reasonably priced? We only have 13 acres. There is some type of pipeline that runs across our property and we are in the Milliken plat.

Also we have been holding off signing our division papers thinking that we would like to separate the surface land from the mineral rights before signing. We may be wrong but thought it would make separating them easier before signing. The second question has to do with this.

For some reason we thought it may be best to separate the surface land from the mineral rights prior to signing the division papers. Do you know where I got this idea? Are we wrong? This may be incorrect so we would appreciate your opinions regarding whether it matters or not regarding signing the division papers before or after separating land from minerals.

If you have a names of attorneys to pass on to us we would greatly appreciate it. We want to get this done as quickly as possible but we are not a wealthy family so need to keep costs down. Thanks for any and all suggestions and your varied opinions so we may find the best course of action. Can anyone give light on why there is such a discrepancy? I tried to contactg EQT about the differences but have not received any response. Any info ro reference would be appreciated.

Hi - How would someone go about getting an accurate assessment of the value or land and mineral rights in PA for estate planning purposes? We are looking for current and future potential values. We are currently unleased but think there is undeveloped shale. Recommendations for assessors are welcome.

Thanks, Lee Ann

This is huge for current and future leases! The is an amendment to the 1979 Oil & Gas Lease Act which A) guarantees a minimum NET royalty of 1/8 (12.5%) to landowners after any post production deductions by the gas company. B) It also directs that royalties will be paid at the market value price in an arms-length transaction with a 3rd party. B) It also directs that royalties will be paid at the market value price in an arms-length transaction with a 3rd party. In other words fair market price instead of "at the wellhead" where post production costs (transportation, dehydration, "marketing") are deducted. Here is the amendment. It's fairly short and simple.

http://www.marcellus-shale.us/pdf/Pa_HB1684_Royalty-deductions.pdf

Now, this has not passed the Pa House yet to become law. But if you have a lease, or have been royalties this will have a major impact on the $ you receive. I urge you to contact your local State Representative by email or social media and tell them to vote yes when this bill comes to the floor. Here's a list

Here is a list of the committee members and their vote record on this amendment.

I have thanked the supporting voters and castigated the dissenters via email and Facebook. Aside from Forced Pooling this is perhaps the most important issue for landowner's since 1979. If you care about the income your lease will actually generate, then it is time to mobilize and spread the word. Trust me, your individual comments to these politicians will make a difference! This is an election year!

Now, be advised that this bill will NOT BE RETROACTIVE. It only applies to payments after it would get passed. And just because this bill passes doesn't necessarily mean your check will automatically be bigger. The O&G's will use every clause in your lease to hold on to revenue. I have some thoughts on that, and will start another discussion thread.

They have leased large areas surrounding us and seem to think we have no other options other than to lease with them. Signing bonus is low ,we think. The lease they sent us seems hastily and haphazardly written. Also problems with royalty language and liability issues. Some of us are concerned, that once we sign and notarizre, there is no deadline or for them to sign or pay bonuses. My feeling in that case is that they could sit on the lase and sign years later Signing deadlines for our signing were mentioned, then changed, but both have passed.
Organize Kentucky Landownerstag:gomarcellusshale.com,2013-10-24:2274639:Topic:5113322013-10-24T21:06:13.856ZSandra Wattenbergerhttps://gomarcellusshale.com/profile/SandraWattenberger

Gulfland Appalachian Energy is associated with Gulf Land and Seismic / or Gulf Land & Seismic LLC registered 2 yr, 4 mo ago and based at 5859 Vicksburg St New Orleans, LA 70124

The land agent presented a card which also references Cimarex, a Multitude of co named Cimarex are located in TX, OK and CO... Cimarex also registered in Frankfort within the last 2 years... A Cimarex co worked with UK and KY geological survey for a report dated April 24, 2013, which featured Lawrence and Johnson Counties in E KY.

The land agent indicated to my sister that a landowner ( an elderly widow) nearby to our family property had already signed with his co.

I would be most interested in

1) Educating myself and family on the oil/gas/lease/royalty situation and determining quality trustworthy players

2) getting a KY landowner group organized to challenge carpetbagger practices which may arise
