Does all land owners in well unitization need to be fully leased before drilling begins?

A driller knows how much land in the area they are looking at is leased. From there they can form a unit. If some land is not leased they will keep contacting that mineral owner. If they can't get it leased they take that unit to the State and show they have enough mineral owners leased and this portion of unleased land is stopping the process.
So yes, but they can't drill.
