anyone have any experience in breaking or changing an "old" oil and gas lease that was signed before the shale issue was public and as well known...almost five years ago?

 

please if you have any suggestions, would be interested in 1] if you have experience with this issue  2] do you have an 'expiring' lease and are you doing anything w/ this lease in making changes to the same...3] any solid legal advice from a experienced oil gas lease lawyer?   would love to hear back from u if so...

I haven't had anything recently . my last offer was 1500.00 and 15% but i am not in a big hurry to sign however the money would be nice.

Bill -  It strikes me that the number of "Jefferson County Members" on this website is relatively low (26).  It may be in everyone's best financial interest to contact the local newspaper --see if they will run a story on local gas leasing etc. to inform people about the  Jefferson County Group-- I would also suggest that a few days before Christmas may not be the best time for a meeting -- people are busy with the holiday rush.

Also, there is some good info. at www.coalfieldjustice.org    -Brian

Yes you sure can ... either go to the meeting in wintersville and sign up or get an application form from Trey . happy to have all the acreage to bargain with ..  thanks  Bill

Agreement to Join The F & M  Ohio Valley Landowners Group No. 1


I wish to join the F & M Ohio Valley Landowners Group No. 1 (“FMLG” or “Group”), and to engage Fisher, Brown, Peterson & Noble, and Morascyzk & Polochak, Attorneys at Law, (“F&M”) to negotiate an Oil and Gas Lease/Top Lease/Lease Modification/Lease Extension/Lease Ratification (“lease”)  for my acreage, which is listed on the “Property Information” section of this form.

LANDOWNER’S RESPONSIBILITIES: I agree that I will assist F & M with providing a full legal description and accurate property owner information for the property described above as soon as possible after signing this agreement. I agree that I give the exclusive right and authority to F & M to negotiate an oil and gas lease and/or leases for my property/properties described above, and I will not negotiate with or sign an oil and gas lease with a drilling operator or other third party as long as I am a member of the Group. I understand that F & M may merge my Group with another group.

F & M’s RESPONSIBILITIES: I understand that F & M shall represent the Group members in a limited legal capacity. Specifically, F & M will be responsible for all costs associated with the Group, Group organization and communication, and communicating with interested bidders. Fisher, Brown, Peterson & Noble will be available to explain legal issues to Group members concerning the Group lease and issues common to all or some of the Group members, however, F & M will not be responsible for giving personal legal advice as it pertains to non-leasing matters unique to individual owners. Group members should consult their own individual attorney, accountant, or financial planner concerning other personal legal or financial issues or for individualized legal advice.  

VOLUNTEERS: I understand that other Group members and “Group Leaders” that may assist F & M are strictly volunteers and are not employees of F & M, nor are they compensated by the Group, and they do not give legal advice. I hereby waive any and all claims or causes of action against any Group members or “Group Leaders” concerning any of their actions regarding the lease negotiation process. I understand that questions on legal issues may be addressed to F & M or to my own individual attorney.

PAYMENT FOR SERVICES:  I agree that should F & M draft and negotiate a lease that I sign, I shall pay a flat fee of six percent (6%) of the signing bonus or delay rental attributed to my oil & gas acreage. As part of the negotiations, F & M will ask that the drilling operator pay all or part of this commission. However, should the drilling operator fail to pay all or part of this commission, I agree to pay the remaining commission due out of the signing bonus money/delay rental and royalty I receive pursuant to the Group lease. I will be obliged to make the payments stated above once my lease is signed and payment is made to me from the drilling operator, and I agree that the drilling operator may directly make payment to F & M on my behalf.

TERMINATION: I, or F & M, may terminate this agreement at any time. I understand that by signing this agreement, I have absolutely no obligation to sign a Group lease. Should the lease terms negotiated by F & M be unacceptable to me, or for any other reason, I may opt out of the Group at any time. The decision to sign the lease will be mine alone. If I opt out of the Group, I will notify F & M in writing immediately so that my property can be removed from the Group.

Brian, the people i have talked with feel he can be trusted and he has joined with one of the firms from Washington Pa. with a good deal of experience in the gas leasing in the Pa. area.
