I promised I'd report from the tri-county landowners' first meeting in Perry Township/Tusc County last night - it will e in two or three parts to fit the space limits.
PART ONE:
Tusc-Harrison-Guernsey Meeting last night was excellent. Standing room only. Informative. Suggest anyone in SE Tuscarawas County/ NE Guernsey/ SW Harrison contact Chris White get on firm's info list - to be informed of the coming trends ahead of the pack. He offers a FREE one hour (as needed) consultation about ANY gas/oil/pipeline and soon power line issues landowners are facing. He addressed New Leases, HBP Affidavits of Forfeiture & Cancellation, Amendments & Ratification &pertaining to pipelines - the important difference between "options" & "Right-of-Way, Eminent Domain &Interstate pipelines (& how to not be bamboozled by those saying they have those rights when they don't!) ...offered tips on negotiating protection & damages..."base your damages on Market Rate and Provable Projection of Damages" (like insurance companies do with their ceilings ). (It was supposed to be a very good thing - as in a hot spot, but am unfamiliar with the term?). Of Counsel with the White Law Office is Ellis Miller who also spoke. I resonated more with his perspectives than any other presenter over the past 3 years of various meetings - haven't checked out his site yet but it's www.pleasantwealth.com. Back to the HBP (Held by Production) it's interesting in Ohio the courts are divided; sometimes having only "free gas" & no royalties from those old wells DOES legally mean the lease is held by production and sometimes, by court ruling it DOES NOT mean the well/lease is held by production - check out your luck, depending on what court serves your area if that is your situation. He also addressed how those in the industry knew 20 years ago that the "Utica Point Pleasant Play" was coming and they have kept those old leases alive one dribble, one puny royalty check at a time, just to hold the rights til now...makes me wonder what those in the industry are talking about NOW for the NEXT 20 years? continued in PART TWO

White shared, among many, many insights, was how you can read and read all the protective, assuring "wherefores" in a good looking lease and they can ALL be sneakily wiped out later on in the contract by a carefully worded replacement clause that you and I may miss! So the Agreement looks and reads really good, but some legalese jargon hidden in the back (usually) cancels the good stuff you thought you were getting! He says he keeps a running record, on a long note sheet next to the lease he's reviewing for clients, and as he goes down each line of the contract he can go right back to his notations when he runs into one of those clever "change the meaning" phrases or even single words he knows to look out for! Sheesh! He has a sample contract he has refined over trial and experience and I read it over - not chiseled in stone but it sure beats everything else I've been handed.

Also, despite scant testing, the "experts" have said the Utica under us in this area is "1,000 feet" - I think they mean thick. That's great but they say that it is primarily oil and without all the other gaseous fluids (my novice term) there may not be the high pressure to propel it - making it harder to access...but "because it is oil, and they know it's here, they will figure out a way to get it in time." One gas company owner said it would be within two years. White said look for things to heat up here - SE Tusc/NE Guernsey/SW Harrison - as early as in the next 6 months. The Carrizo Rector 1H tested at a peak rate of 1,680 Bbl/d of condensate, 5.2 MMcf/d of residue gas, and 266 Bbl/d of NGLs, assuming ethane rejection and a natural gas shrink of 7%, or 2,816 Boe/d on a 24/64 in. choke.
Seen some Hess well results today in a presentation. The A2H-8 did 1,421 BOE 66% liquids. The A3H-8 did 1,211 BOE 65% liquids. The A4H-8 did 1,819 BOE 67% liquids. These wells are located in Oxford Township.
In the Utica Shale, Carrizo's first well, the Rector 1H in Guernsey County, Ohio, continues to perform well on its long-term stabilized test. Over the first approximately 48 days of production, the well has averaged 553 Bbls/d of condensate. The well continues to flow at a stabilized rate of more than 500 Bbls/d of condensate and 2.0 MMcf/d of rich natural gas on a 15/64 in. choke. Carrizo has a 95% working interest in the Rector 1H well.
Carrizo expects to spud its next Utica Shale well, the Brown 1H in northern Guernsey County Washington Township in March. Carrizo currently expects to drill 9 gross (7 net) operated Utica Shale wells during 2014.
I have wondered if it would be a good idea to limit the number of days that they can flare. How long do they really need to flare? That is some landowners royalties going up in smoke.
Just FYI - someone I know is receiving royalties for a well in Guernsey County. I have seen the first 5 months worth of royalty data and it works out to $1,075/acre per month.
I'm not sure how much liberty I have to give too many details but I can tell you I saw the royalty statements and $1,075/acre per month was the net check to the royalty owner. 20% royalty and I think it was Millwood Twp. There were 4 wells total in the unit.
Jeremy, am I to understand the$1075/acre per month is for 1 well in a 4 well unit? If all 4 wells of this unit were to produce at the same rate as the one well, the royalties would be 4 times that?
Sure hope someone goes to the sept 20 auction of the Metheney estate and reports back here. I'm not able to go myself. I think it will be a nice indication of what the minerals are worth in that neck of the woods! Thoughts?

The Metheney Estate Oil & Gas Lease is only a 12.5% Net royalty lease and is signed with Chesapeake who will likely take every deduction possible, leaving little to nothing for the mineral rights buyer. I would say that it's a very risky investment. Any thoughts?
Yes my thoughts exactly plus they leased all formations which leaves no room for future mineral buyer to negotiate a new lease. I haven't talked with any mineral buyers but I believe your net royalty effects what they offer for your minerals. I could be mistaken.
Beaver Twp Jacks Run Rd Noble county doesn't have any wells that I know of yet! I know of one just before Millwood Twp county line it's Eclipse and it suppose to be a shallow well that Oxford start and Eclipse Resource finish.

We signed with TGS earlier this year for seismic testing on our property in Center Twp. There have been several blue & white ribbons on the property for several weeks and they were there yesterday placing pink flags in the meadow and we could hear equipment running on the far hillside. We were working on a project and didn't go down but there is a chance that is what you could be referencing. Our property is north of I-70, between Arrowhead & Battle Ridge.
We are in Oxford Twp. It's not actually property I own. I just lease it for pasture. Our property is directly across the road and there are no markers on it. There is a well that acts as our night light but we aren't in it. So, I'm curious.

This well as a DRILLING UNIT would pay Royalties on just 203 acrs.. big money for land owners..

The reason a company would make one well a Production Unit is they can HOLD all 640 acres.
As a Drilling Unit 203 acres....they cant hold all of the other 640 ...
Just trying to find out what is what on this...
AS a production unit .. if there is 6 wells on ONE PAD in that 640 .. EVERYONE gets a royaltie off ALL SIX WELLS.. that's good also....
