Have land in Bradford county and our 5 year lease is up. They are not renewing.  Has anyone else resigned with another company in the area?

jen,  I live in western beaver county.  my lease just expired.  they are letting leases expire all over the place.  I know this is no help but your not alone with this!

Getting out of a lease with Chesapeake is a good thing. Count your blessings, IMHO.

If your lease has EXPIRED then you need to get a RELEASE OF LEASE on file with your county recorder's office.  This will show other companies that might be interested in leasing your ground that the old lease will not be an issue.

It will be easier to obtain the Release before having another company show interest rather than after you sign a new lease.  If Chesapeake knows someone else is interested they may try to find a way to re-activate the lease or at the very least try to kill your new deal.

You should read your entire lease over again to see if it includes any specific procedures that need to be followed upon termination of the lease.  Some leases have a clauses that let the Lessee, Chesapeake, match an offer up to a year after their lease has expired and renew the lease.  Some have clauses that say you have to send notice, in writing, that the lease is over, even though the time period for the lease has clearly expired.

Many leases with Chesapeake require notification be sent via Certified Mail.  There have been reports that recently Chesapeake is just not signing for the Certified Mail that is being sent to them (because of all the lawsuits being filed against them).  If you find this to be the case try also sending a copy of your notice to Chesapeake via Express Mail, FedEx, or UPS.  They won't be expecting notification sent via these methods and they usually just sign for deliveries via these methods thus giving you the needed Signature for proof of acceptance of delivery.  If you need to get more creative, put the notification in a box instead of an Envelope (which would indicate they are getting documents just by package it was sent in).

Since Bradford county has many operators working, you need to be more specific: Township at minimum, better yet what area of the township.
