What is the going rate for pipeline easements from Bluegrass Pipeline? They want to pay by the acre with a 50 foot perminant easement. I always thought you got payed by the inch diameter per foot? What is the going rate per acre? They only want 2 acres across my property.

It is a 20" line and they are paying 15,000.00 per acre for the permanent easement. Sounds a little low to me!

Because this is an interstate pipeline, do they have the right of eminent domain? 

Once FERC issues the certificate of approval, they first have to acquire a threshold percentage of ROW parcels, then the eminent domain enters into the equation. From my understanding, this pipeline is for export purposes out of an Louisiana facility, not for public necessity. However, they indicate to supply industries along the projected route. This would be the trump card to establish public necessity in order to implement eminent domain. This is a time sensitive project as eminent domain court cases would tie it up too long in court. Landowners have the provision of The First Amendment for trial in court. I would assume they would use land condemnation in lieu, if Just Compensation could not be agreed on. Just my opinion.
