Has anyone heard of a Federal Regulation that says an abandoned pipeline must stay in the ground?

I'm in PA, and I wanted an addendum added to my pipeline lease that states, "If the pipeline is considered abandoned, the pipeline must be removed." The pipeline land man said that they can't do this because they follow Federal Regulations, which say that the pipeline remains in place. Does anybody know about this regulation?

Hmmm let's think about this one if that where true how would they have been able to replace old lines with new ones?
If I where you I would call the company this landman is representing and ask them that question then ask them if that is how they like to be represented? Then I would tell them not to send that person back to my farm ever period.

Philip; excellent article, thanks for posting it.  Reading this, one can see how complicated a ROW agreement will be.  Hopefully, anyone approached about one will get a competent attorney to negotiate on their behalf.

IF A LANDMAN OPENS HIS MOUTH HE IS USUALLY LYING .........ALL HE IS AFTER IS A SIGNED CONTRACT SO HE CAN GET PAYED ....EVERY FOOT HE GATHERSW HE GETS PAYED .....THE CHEAPER THE COMPANY GETS IT THE MORE THE LANDMAN GETS .........USED CAR SALESMAN 

We have it in our agreement that the company must remove lines after they are abandoned , they fought us on that one but finally agreed to it.

Fifty years from now they may come back and install a new pipeline using the existing ROW.

I have asked the pipe land man to produce a copy of this so-called Federal Regulation. I haven't seen it yet. I will let all of you see it if it actually exists.
