Mineral vs Landowners

Two weeks ago I made a trip from where I live in Virginia to Greene county Pa. in Jackson and Center township near Holbrook , Pa. I wanted to and did meet the landowners who live above my mineral rights. They were very friendly and hospitable people. A lot of questions were answered and many new ones were not.One of the landowners was told that they had all the mineral rights and we only receive royalties. We read the lease differently. There is an oil well on one of the properties that has been and is still producing, named after my great- grandfather Hampson. It seems to be a mystery, however who has been receiving the royalties from this. One family says the people living on this property are already leased with a company which they deny. There is also additional acreage that they do not know who owns it. My cousins and I have hired an attorney from Waynesburg to help sort all of this out. I would suggest going to the DEP (Pa state Dept of Environmental Protection) and see who is the operator of record. They may also have who is the oil and gas owner.  Keep in mind that in Pa the term "mineral rights" does not include oil and  gas. For you to own the oil and gas the original deed reservation must say oil and gas. If the deed reservation just says mineral rights, that means you own the coal, limestone, gravel, and other hard minerals but not the oil and gas.

Thanks so much for your response. The deed definately mentions oil and gas, coal, limestone, etc.. Now we will have to decide who gets what. I will try the sight you mentioned.

If you find the operator of the well, contact them to see who they are leased with and paying royalties to. See how long ago this was done and was it a local driller or a major.  Some local drillers weren't as determined to do a full deed search for rightful owners. You may need to have an attorney or title company do a full title exam.
