Very interesting post, David. First, I'm genuinely sympathetic to your plight. In-the-shale New Yorkers have received a really raw deal. This includes both Marcellus landowners and also NY Utica landowners out further west, many of whom I think are not even aware there is NG beneath their property!
The tax angle in NY is not something of which I was previously aware. Course I was only just beginning to get into this NG thing back in 2008. It's also a given that in NY even the most meager excuse suffices to raise taxes.
Here in (Bradford County) PA, our taxes have not been impacted owing to (unproduced) NG. NG already produced here has resulted for royalty owners in both higher (income) and lower (county) taxes. We must pay income tax on royalties actually received, but our county tax rate has declined owing to Pennsylvania's impact fee.
Why would you punish the citizens of NY with a tax ? I believe most of them either support shale development or are indifferent. It is a few vocal extreme environmentalists and self serving politicians preventing shale development in NY.
The real answer lies in action by the silent majority that supports shale development. An example is the law suit proposed by David.
It may turn out that NY getting into the shale Oil & Gas play late, may have prevented a large theft of royalties that have occurred to date in each state the drillers have landed in, assuming we get the producers under control soon.
No other state has been able to stop the theft, and I have to wonder why the governor & attorney generals are still at large in those states, when they have failed to protect the people of their state as they were sworn to do. I would think allowing theft from the people of their state would result in a tidal wave of letters to the Dept of Justice to investigate their Corrupt Politicians.
The best way to stop a producer from buying your states gov & atty gnl is to contact the FBI and have them look in on your Corrupt Politicians.
Put your corrupt politicians in prison and their replacements will vow to protect the people.
Next, go after the producer using the US Attorney Generals Office or Dept Of Justice.
Choose to sit on your duffs and do nothing and I guarantee the stress of monthly royalty theft will eventually cause your early demise.
Hopefully you will all live long and take action against this theft in progress across our country.
If you believe you are not being stolen from, ask yourself why you are not a millionaire while the oil and gas producers are making Billions off of your land.
If you made less than $700 per acre per year as we did at Buck Well 1H, you definitely have a theft problem.
It seems to me if you think you are being robbed of royalties, the first step would be obtaining an audit of your lessees production, sales and sales contracts, so that you have real facts to work with. Since this is very difficult for an individual landowner to do, it reallly must be done by the state, which also has an interest in not being robbed.
Getting an audit of O&G companies done by the state auditor would require new legislation and for that we all should be turning to our state legislators.
