Late this afternoon, February 24, 2011, the House Judiciary Committee approved HB2878 WITH NO FORCED POOLING PROVISION. The bill was supposed to go to the House Finance Committee but late reports indicate that this requirement may be waived allowing the bill to move on to the full House of Delegates for approval. The House allowed some changes pertaining to the construction of roads and pipelines on surface properties as a concession to the gas companies in order to allow the bill to pass. Legislators warn that an attempt to add the Forced Pooling Provision back into legislation may occur between now and the end of the legislative session, but it is widely believed the that House would not support such a move.
