What was the outcome of the Buell/CHK lawsuit?

I've been searching for the court's decision on the lawsuit Mr. Buell filed against CHK. Does anyone know if it has been decided, yet, and what the outcome was?

I do not think it has been heard yet.  I'm sure it will be settled out of court i imagine.
