Has anyone in the northern Mercer County area (Kennard/Osgood) been approached by a land man from Midwest Land Services, representing D&L Energy?  I have an existing 10 year old lease with one well and they left me, on my porch, an amendment to unitize my 23 acres.  It doesn't have any other changes to the lease other than changing the size of the pooling and unitization to 1,280 acres.  I called the guy who left his card and asked him "what's in it for me?"  My question is, do I have any leverage to get a higher royalty percentage or up front money and should I see an O&G attorney before signing anything.  Anybody else have a situation similar to this?

There is another thread about D&L Energy before anyone has any dealings with this company you should read others experiences...

Or ask most any land owner in NW Pennsylvania....

As for myself I wouldnt deal with D&L if they came with cash in hand!!!!

Go see an attorney.  Maybe Doug Clark.  Your existing lease probably doesn't allow pooling of acreage, you might have a little leverage.  Ask your attorney about getting a hold harmless clause if your lease doesn't already have one. 

I saw an attorney last week. He said I don't have much leverage and that he hasn't had any luck getting D&L to raise the royalty percentage. He's seen several of the same amendments and it's a pretty standard document. I can either sign and take what I can get or hold out and see if they'll offer anything more or maybe nothing at all. I'm not sure what to do.

ESCALES5057 - There is always room to negotiate an amendment.  If your old lease is restricted to a 640 acre unit, they need the amendment.  Some of the units I have seen actually are as large as 1240 acres.  If you want to friend me, we can exchange emails on the side. 

So, does anybody know if or how this mess that D&L Energy has got themselves into, will affect our existing leases in Mercer County?  From what I've been reading, their permits to operate in Ohio have been permanently revoked, but I'm not sure how that affects us in PA.  Ben Lupo has had his name associated with as many as 70 businesses in Ohio, many of which are located at the same location as D&L Energy.  I think this guy is as crooked as a dog's hind leg and I wish there was a way I could cease all dealings with D&L.  From what I understand, a lease cannot expire or be terminated unless there is little or no gas produced from it over a long period of time.  Is this true?  I sure would like to figure out how to cut ties with D&L.  Thoughts anyone??
