If acreage is currently leased and has producing vertical wells, can the current oil/gas company drill horizontally without modification or addendum?  Don't they need the wording to allow pooling added?  Can we expect additional compensation for this?  Has anyone been involved with this situation?

It depends on your lease. We have a similar situation in Ritchie. They were going to need to increase the pool size from 160 to 320 and were offering a nice amount of money to do that; they really needed our tract. We stopped hearing from them and I saw where they filed the plat for the pool; it was 610 acres and I was ready to go talk with them and threaten; then I saw that our lease allowed pooling up to 160 acres for depths shallower than 6000; 640 acres for deeper than 6000. Their target depth was about 6500 so it looks like no negotiating but at least we will be in a drilling unit and should get some royalties from it. So look at the lease and be ready if they talk with you.

Do you know about the WV Office of Oil and Gas website and the info available about new permits?

Go here

http://www.dep.wv.gov/oil-and-gas/GI/Pages/WeeklyReports.aspx

to see the weekly reports. The plats are arranged by County, so that helps.

Go here

http://www.dep.wv.gov/insidedep/Pages/DEPMailingLists.aspx

to sign up for the email updates about new permits. This comes out about a week before the weekly report, but is only a notification and a link to the map website. When you get there, put in the API number on the email. This generally doesn't work the day the email comes, but wait until the next day and it will show where this permit location is.
