The Opt-Out Date for individuals who are part of the Class Action Suit Against East Resources have one week to opt out of the settlement, if that is your intent. How do you opt-out (exclude yourself) from the Settlement?
To exclude yourself from the proposed Settlement, you must mail a letter saying that you want to be excluded from PRC Holdings, LLC v. East Resources, Inc., No. 06-C-81(E). Include your full name, address, signature, and date. You must mail your request for exclusion to the address listed below so that it is received by October 17, 2011

You cannot ask to be excluded on the phone, by email, or at the website. These are old Pennzoil Leases (now held by East Resources) that were signed long ago that affect approximately 20 West Virginia Counties including, but not limited to Monongahela, Wetzel, Marion, Tyler, Ritchie, Pleasants, Wood, Etc and many others along the Ohio River. You need to determine if your lease is part of this suit. The Settlement total is only $6M and at least half of that goes toward attorney's fees. It's possible that by opting out of the suit, you may have the opportunity later on for the Courts to declare the lease(s) invalid. Many of the leases have been dormant for many years and to some observers and participants, this appears to be a "backdoor" method for East Resources to "validate" their leases on some 100K acres of oil and gas leases for a very cheap price.  Please Govern Yourselves Accordingly!
