The companies want Forced Pooling now more that ever. We are nearing the five year mark of the leasing explosion. Thousands of leases, which heavily favor the companies are coming due to expire.

This is the same HB 3042 from last year (2011). First of all, hidden in Section 22-C-9-2 "Definitions" is the proposed definition of "Net Proceeds":(7) “Net proceeds” means the actual proceeds received less post-production costs incurred downstream of the wellhead, including without limitation, gathering, compression, treating, transportation, and marketing costs; .  "Without Limitation"????? Sounds like a blank check to me. The Forced Pooling part allows the gas companies to pool properties that are currently under Lease, not just the ones that aren't. If you object to them pooling you property, you do get an opportunity to object to the "Gas Commission Board"...appointed by the Governor...Industry People...sound familiar? Please contact your Legislators now. Email is fine but calling is better. When you call, the Legislator or their assistant(s) may tell you that this is a carryover bill and not to worry about it. If the Legislator is not available to speak to you, ask for them to return your call. Don't let them get this by undetected. This is how egregious legislation is often slipped through the system without fanfare or notice. They are hoping that the public has let down their guard after passing the Marcellus Bill. There are some of these Legislators that want to give away your rights to the gas companies. Let's tell them what we think about that!!!!!!!

This would only require them to get 75 percent of the land leased and then they can take what ever else they need.  If the oil and gas rights are severed from the land and the heirs can not be found then the oil and gas right should go back to the land owners so they can sucessfully negotiate a lease.  Let the current land ownes get the benefits on the land they pay taxes on every year.
