This landman came in and signed some landowners in my area.  I've read his lease and some things just don't sound right.   The following bothers me the most:

Lessor's Covenants.  Lessor hereby covenants that he is seized of an indefeasible fee simple  estate in the land herein before described, together with all the underlying  oil and gas, and that he will forever warrant and defend the leasehold estate hereby demised unto the lessee against the lawful claims and demands of all persons whomsoever, and that the lessee shall have the exclusive, full, free and quiet possession of said described premises for the purposes and during the term herein set forth.  Lessor further agrees that the lessee at its option may pay and discharge, when defaulted, any taxes, mortgages, or other liens existing, levied or assessedon or againstthe above described lands, and in the  discharge of any such mortgage, tax or other lien, any royalty or rentals accruing hereunder.

 

This sounds like much more than a Special Warranty of Title.  Can these gas companies take more than just the oil and gas with a Lease?  What are your thoughts on the above paragaraph?  What is the landowner ACTUALLY signing away?

 

1. Reserve gas = 200,000 cubic feet per year.  Most are 350k and/or a monetary value.

2. No mention of the word "Gross Proceeds" and when asked, he stated XTO wouldn't allow it.

3. $20,000 total for a pad site, includes 7 acres and can take additional acreage for $3k/acre, no limit.

4. Nothing for Workers Comp or Liability Insurance, Umbrella Insurance or Business Auto or Liability Insurance.

5. Nothing stating No Pits, No Compressor or Processing, No Hazardous Materials, No Disposal or Injection Wells.

6.  Conveys all rights to drill and operate for oil and gas in ANY underlying strata....

 

Am I missing something?  The landowners that signed this lease have been involved for almost a year and signed this lease without even having their lawyer review it, and they own near 300 acres!

Psychosid it has been said you have read the Lensman lease, if so who is it with? Is it really this Brencoe oil that is mentioned on here earlier......Can any light be shed on this and if not why? Thanks

Matt, I am not in Belmont I'm in Monroe, we started our land group as Adams TWp landowners and grew so much we changed our name to Eastern Monroe landowners and now we have members all accross the county and adjoining counties. We just hired Lensman & Associates to market our Minerals by plotting & submitting to all the players n the shale, You are much better off with a landowner group that is looking out fot their selves & their property as well as their neighbors VS a landman that gets paid by the oil company? Who do you think has your best interest at heart?  I have been around a long time & learned you do what the person signing your paycheck wants. 
 
Now because i've questioned the great Lensman deal i'm Mark Leeds, are you people this paranoid about your deal?????? Again if it is such a great deal you should be happy to share it with all of us instead of hideing the main details and insulting everyone who questions it!!! @ HMMMM what do you have a problem with what I state that you copied and pasted? We are a nonprofit landowner group! We called, Interviewed and Hired Lensman and associates to work for us! Thats the key we employ them! I can understand why a landman would hate attys and landgroups that protect the landowner, it changes the way things have always been done and the landowner isn't still being raped by the oil & gas companies,

As far as why they won't discus the deal with you is that they probably have integrity (which I'm sure is something new to you), when you make an agreement and sign a confideniality agreement integrity means you don't give the info out!

I think you know you gave yourself away here who you are, you have been very demanding who they signed with & started out with that there was no company then you bring up the name that was posted on here by Mr Leeds that he claims doesn't exist as he can't find a Web page so you had that info all along?, then you say Mr Leeds was threatened with Legal action by this big bad non existent company.  That was never posted anywhere on go Marcellus so how would you have personal knowledge of that since Mr Leeds deleted most of hist posts and disaperred? the only people that would know that is the prerson threatening & the person being threatened with legal action!HMMMMMMMMMMMMMMMMMMM

Exactly WHO presented you with the LA Lease?  You will be questioned by a lawyer from Lensman as those who have THE ACTUAL LEASE signed a BINDING DOCUMENT OF CONFIDENTIALITY.  I hope it's worth it to the guy that gave you a copy of Lensman's Lease because I'm pretty sure he will be sued by these lawyers from Canton.  On the other hand, hopefully you can make the lease you had floating around about a month ago a lot better by incorporating some of their addendums in the XTO lease.

Integrity is nothing new to me, i'm one of the one's who signed with Mr. Leeds and was and am still happy i did, what makes me mad is people like you who are on here causing problems and you have no acreage in Belmont, go to the Monroe discusion you goof! My biggest concern was to make a block so i would be drilled right away. Got news for you just because Mark isn't in this county doesn't mean XTO is not still buying!!! If it is a real deal....Who is it with! It has been said it is with a company that doesn't exist! Sounds like they are still trying to shop it????????   Enough Proof? HMMMMMMMMMMMM!!!!!!!!!

XTO said they are done for the year and would likely pick backup in early spring.

I can only assume that in light of all the acquisition in the past 4 months that it is time for Exxon, Hess and Chevron are taking an inventory of what the spent their billions on.

I’d guess a second round of leasing to fill in plots will start after the first of the year. And a frenzied third round after some area production reports.

The fact that XTO told me they were done for the year does not mean that Exxon is done or Permian Land Company is done, In fact, I know firsthand that they are not done.. and would not be surprised if they made an appearance with a big group signing. In Belmont I don’t see their (Exxon, XTO, Permian) number changing much from the October number 4950/20. Hope it works out, I’d like to wait for well results to get a better understand the mineral value.

HMMMMMM and Tom, thanks for giving us something to read the last couple days but I think its time to call a truce.  Those people that signed with the LA group and under a confidentiality agreement.  Nuffff said, also I got an email from XTO on the 12th of this month, yesterday stateing that they are done leaseing for the year due to financial restraints.

 

Man, this HMMM! cat can cut and paste with the best of them.
