i have a 1 acre parcel and chk has signed everyone around me in my neighborhood.  they will be declaring a unit here soon.  my question..canchk  not sign me up even if i want to be in the unit.  this 1 acre would be in the unit if i were signed but they never approached me.  i have had some dealings with chk...just wondering...am i being blackballed and is it legal?

Are you leased to them?

i have other properties with them... but not this lot.   this has happened twice to me.   everybody around me gets approached...i am ignored. 

My guess is that you are either already leased or don't own the mineral rights.

Please someone correct me if I'm wrong here. They can force you in but it's not as easy for them as say a utility co. They would have to prove they gave you a fair offer and you are just holding out and hurting your neighbors. They would have to have 90% of the drilling unit leased. From what I can see in my area is once they are getting close to a proposed well they will hound you and hound you to sign if your land falls into the unit projected.
Have all your neighbors received water test papers? How do you know a well is coming? Even if you are next door to the well you may still not be in the unit since they only run in certain directions, and they don't need you yet.

This guy never said where his property was located, he may be in PA and not Ohio and thus your ODNR references mean nothing.

I am in Beaver County, Pa.  Everybody in the neighborhood has city water.

My questions is....do they have to approach me with a lease if I am going to be part of the unit.  or ..... Can they not offer me anything and still put me in a unit as an unsigned parcel?

I've had some less than good relationships with chk and I'm wandering if I am being blackballed.  I want to be in the unit, I am not asking anything more than what my neighbors got. I was never approached and everyone of my neighbors around have been. 

Is this legal?

just wait for the unit declaration to come out.  Maybe they indend on drilling around you.

I'm wondering if you googled this question even once? Your second to last reply seems like you just want someone to give you the correct answer without devoting much time to it.
I would read all of these including the gomarssellus link from January. I read that link a bit ago and found a site that basically said due to the way the law is written now "yes" they can just force pool you, drain you, and you have no recourse. They say they snaked around you but do to the way shale drains you could be fully drained but no one know for sure yet. On one of the pages from that discussion is a unit drawing that shows unleased propery in it in PA.
I also would look at the bottom of all the links to see if more informative links are provided. One says the governor of your state is trying to do something about the Marcellus since at this time no law covers it.
Here's another one. Scroll down since the first artical concerns the new law that went into effect. At one time the forced pooling issue for the marcellus was in the law but removed.
