hi my cousins and I have been approached(I haven't talked to him yet) by a fellow claiming we have approx 100 acres of mineral rights in Ohio county  that we supposedly inherited when our last aunt passed in 1999....he wants to negotiate a lease,,,we have no idea how that can be as nothing was noted in her will or our inheritence ,,,,, I live in Indiana but understand that WV assesses property  taxes on mineral rights only....is that true?..... as we have no knowledge of anyone paying those taxes all these years,,,,  chuck

You may be able to find out from them if indeed you still have the mineral rights. They may be able to help you. If not it would be possibly hiring an attorney to check it out or tale a trip to find out. Most importantly DO NOT SIGN ANYTHING TILL YOU LEARN MORE!

If he wants to lease your rights, it's in his interest to make it clear to you exactly what you own and how he reached that conclusion.  Ask for everything he has, then take that to an attorney for verification.

It would not be surprising that the assessment office does not list something in your name, if the estate was complicated, and since you live out of state.  Ownership will be decided by the deed records and the estate papers, not by what the assessment office says.

It is true that the assessor's office sometimes has incorrect or old information. However, it is never a bad idea to try to find out what they have, in my opinion. Perhaps the aunt's will is on file. Or perhaps there is a document with the aunt's name on it on file. 

thanks folks for all your info  the lease contract finally came ..it looks like we got the mineral rights through our grand parents...Chesapapeake is offering about 3k royality an acre in Liberty District in Ohio county and 14% Royality if any gas is extracted  I've read 5k per acre and 19% royality is more the norm  can anybody validate that?   chuck
