Thank you, Thomas Booth, for your very informative post.

I agree with all the positives you noted in the "forced pooling" legislations of Oklahoma; but the forced pooling provision, as it was written in our Senate Bill 424, gave all the power and benefit to the oil & gas companies - rather than the best interests and protection of the owners and environment, here in West Virginia.

I am not opposed to finding a working compromise for West Virginia, her citizens and the oil & gas industry : but the forced pooling provision, as it was written in Senate Bill 424, is definitely not it.

We are as eager as anyone to see West Virginia reap the benefits and prosperity of the Marcellus Shale Play - just not at the cost of the rights of West Virginians, or the destruction of our state's natural beauty, resources and environment.

With planning, education and communication all of these issues can be addressed and resolved - but "forcing" any legislation upon us by hurriedly pushing provisions through the house, will never sit well with the majority of West Virginians

Thomas, did you read all versions of HB3042 and SB 423 or listen to any of the streamed hearings?  No provision for signing bonuses, poorly defined or completely undefined terminology, and on and on and on.

 

We understand that the bills were put together by the DEO and large gas companies.  No imput from mineral owners, corporate or non corporate.

 

it would have been a legal land grab.  Other than big gas, the only group to benefit would be the Trial Lawyer's Association, as suits would have kept their members in business for generations!

 

Are you famiiar with the Tawny lawsuit, one of the largest anti-business judgements in recent history, which was over royalty calculations.

 

In West Virginia, you're visiting a different planet!
