Anyone negoitiating a lease keep this in mind. Our Attorney put a clause in our contract and taxes- current or future, costs for gas refining, transporation, etc is the sole responsibility of the gas company, not the landowner.

That might help you, depends how the E&P interprets that clause. I would consider this when choosing the company you lease to. Be very picky and find out how that company has been treating its royalty owners.

It is imperative to get all the most advantageous language into the lease document, because even the best working relationship and understanding of the parties' intents will be worthless if the lease is assigned to a different operator, or the existing operator is acquired or merged into a different company.

This is a list of the people Naying our bill !  Call , write, phone, holler cause if they do not pass this Bill I call to take back the wells!  We could suck our own gas , sell it and take care of our community !  

They should be kissing the feet of the citizens in BRADFORD COUNTY we are the ones hauling in the money but NOT FOR US, NOPE, all the landowners and the the people have gotton NOTHING but lies, polluted water bad wells and the list goes on and on....! Chesapeake has put ALL Landowners in a financial bind by STEALING ALL the money they gave us! That was money was to put our people to work, spend in our communities now some of us are getting bills that we owe Chesapeake. MONEY!  WHEN THAT HAPPENS THERE WILL BE RIOTS!

Each and every promise broken by Chesapeake and SOLD OUT by our Politicians!! You sicken me, some sold their farms , cows hoping to pay their taxes! Now we have to wait for Chesapeake to just take our homes to! WE HAVE BEEN IGNORED!  I could not pay my taxes and the IRS was going to put a lien on our home how GD pathetic you are!

These are the people NAYING the rights of landowners and I urge you to call , write , holler and make sure they hear they will lose their jobs if this bill is NOT PASSED!  If they side with Chesapeake and the other Gas and Oil Companies you better be ready for riots!

We have been CRAPPED ON ENOUGH IN BRADFORD COUNTY.  If you cannot fix this and fix it before the scum suckers steal any more money YOU NEED TO GO!  They  ruined our water , stole our money and continue to destroy our Community while YOU have sat back and done NOTHING!!!!!!!! 

I thought fracking was safe.

Did you not read even just parts of the actual bill?   This bill will not be retroactive, which leaves anyone with a current problem with royalties stuck with what has transpired. Only the future of all leases will be affected. That's my take on it.  Not such a good thing, heh?

Politics! Politics! Politics! At least here in Ohio. I actually personally spoke to one of our state senators, Lou Gentile, for about an hour last week. Even though he seemed like a very sincere young man, it was still politics as usual. I contacted him with my concerns about some of these land men coming around to property owners and basically telling them whatever they wanted to hear to get them to lease their minerals and not having any state regulatory agency to oversee and license these people to hold them accountable.

I was told by Mr. Gentile that there was a bill put together by the Democrats here in the Ohio Senate that would help to address that exact issue, and that it never even made it to the floor because of Republican resistance to the bill. 

I also addressed the Market Enhancement Clause with him that has been put into a lot of land owners' leases that shifts a lot of production cost onto the property owners in the form of deductions taken from royalty checks, while being lead to believe that this would be a minimal deduction that would be taken only if some advertising was done to enhance the price of the gas. I know this for a fact because, as I stated on this site before, it was done to me personally.

We also discussed all of this new technology that has been developed to be able extract the gas from the shale and how it is making oil & gas a marketable resource here in Ohio. I also explained to Mr. Gentile that these O&G companies can develop all of the technology that they want, but without land owners like me and the thousands of other land owners that put up with all the noise, mud, truck traffic, bad roads and all of the other crap that we land owners put up with, where are they going to apply this technology if we aren't willing to lease our mineral rights. I am so tired of hearing people say, "Well, if it weren't for the technology that was developed to recover the oil & gas, it would be worthless to you.

"Well, let me tell you as I did Mr. Gentile " These O&G companies can develop all the technology they want, because without our ground to stick it into, it is just as worthless".

We also discussed all of the money that is being pumped into political campaigns by the O&G companies to help get the politicians elected that will side with the O&G companies is ridiculous.  As I told Mr. Gentile, this reminds me a lot of Southeastern Ohio back in the late sixties and early seventies when the coal companies came through and bought farms up for pennies on the dollar and then made billions of dollars from the coal that they mined from these places for the next forty years.

We also discussed a wonderful deal that was done by our governor on state-owned lands, and then denied by him. But that's a completely different story, but an equally as sad one.

Mr. Gentile did inform me, that if I did want to attempt to get a group of land owners put together who were tired of these issues, he would be more than willing to meet with them and attempt to take their issues to the Ohio Senate for discussion.

I guess the gist of our conversation ended up being this: The Ohio house is Republican dominated right now, and since all of our politicians are so willing to work for the people's best interest -- NOT! -- don't expect any usual legislation to come out of Ohio to benefit the land owners.
