My current property has an existing lease with a company. They haven't made good on their lease. I bought the property 1 year into the 10 year lease, they were notified that I was the new owner. Fast forward to I have never received the delay rental payments. I notified them by certified letter asking them to satisfy the terms of the lease or to file the release in the appropriate county. I gave them the 30 Days as specified in the lease terms to respond. I never received anything back from them at all.
Is there anything I can file on my own for the release or do I need to sue them for the breach of contract to get it existing lease agreement release filed?

The contract read that they have one year to commence a well and if a well wasnt commenced in that time they were to pay $5 per acre per year and it was to be paid quarterly. So 32acres *$5=$160 and so they should have paid me $40 quarterly. So technically they could have paid me the $800 approx. to bring the lease current, but they failed to respond within the 30 days specified in the lease. This is technically the 5th year of the lease and not noted as a "paid up" lease
