Hilcorp dropped its attempt to be the first company to force pool landowners into a lease for the Utica shale They were trying to force pool several landowners near Pulaski, Pa. Its my belief that they realized that it would take years to go through the legal process and they didn't want to delay development of lands already leased as those leases would soon expire.
As it had never been attempted before, it would have at least gone to the Pa Supreme Court and perhaps beyond, meaning it would have taken many years to settle. Now the question is, will some other company initiate a test case and if so, when and where?
