Does anyone know if the Kinder Morgan Utopia East Pipeline proposed to run from Harrison County, Ohio, to NW Ohio qualifies for eminent domain status?

Permalink Reply by Bob Shaw on March 1, 2016 at 8:19pm Since it does not cross the Ohio state line, a FERC permit will not be required. Most likely will not have access to eminent domain.

Permalink Reply by Billy Bob Meeker on March 2, 2016 at 2:38am Yes, the Utopia East line crosses one of my family's farms in Archer Twp. and, yes, it has been formally appraised by Kinder Morgan's representative appraiser. KM has made a fairly reasonable cash offer for the ROW, but the route being proposed is unacceptable and they seem deaf on that issue.
