We have a property that we have owned for 33 years and do not have mineral rights. we would like to know how to recover or get them. according to our deed we do not have them. the previous owners are deceased and we do not know about children. Is there a way to recover these rights??

The first thing that I believe you should do is establish if the prior owner had them or even if the owner prior to them had them and who has them now. Once you establish the party that has them you can map out a plan to see if you can aquire them.
You would have to go the court house and receive these documents and look through them. As Steve said, who prior owned the land before you did or even past owners. The first person I would ask or find out from is if the previous owner had children. And mineral rights are completely different then gas and oil rights I believe.

Don't spend any more money withTHAT ATTY. Start with your title Co. you bought title insurance when you bought the property and they can give you some FREE assistance on this matter, Be persistent as they may want to be lacidazical (SP) Let them find out who has them then check your agreement of sale as to wheather it included them or not, the devil is in the details.
