I'm sure the Bounty rep would not wish to mislead you, but they can say "we'd never want xyz", but once the minerals are sold, they are sold according to the documents used to convey them. If they do not specifically exclude coal, then the rep's opinion isn't worth much later on when the strip mining equipment is pulling in. My lease excludes specific types of minerals and it explicitly excludes coal. So, it really needs to be in writing what rights you are selling and what rights you are keeping for yourself.
Permalink Reply by Dana Lang on March 5, 2013 at 8:32am Yeah, the contract reads-no surface minerals,including coal,sand and gravel,bluestone.But he said the surface use(if it comes to that) would come under the same 'rules' as is written in the contract with the shallow well company Cap Rock.
