I have a quick question for all of you who have been through the lease process. If the well has been in production for almost a year and you had no lease but the company has been tapping the gas on your land are you able to recoup the royalties after the fact? I am working on a lease for my mother and found out the above noted well has been in production since July 2013. I thought Pennsylvania law requires a 12.5% minimum royalty if your land is used and no lease.

The company SouthWestern Energy has offered 500 per acre lease and a $5,000 bonus to lease the land just want to find out if that is a fair offer.

Any replies/information will be greatly appreciated.

Received the lease today. Contacting attorney. Can someone please post what the attorney fees most likely will cost for negotiating and making sure the lease is a fair offer?

Could be anywhere from $150 to $300 per hour. Depends on the attorney. SWN was pretty fair to us. They are one of the better companies out there
You want lease language to read no deductions for production/marketing etc...
