Question about Utica Shale

We have not signed a lease for our property yet.  I have a question about leasing.  What if you  sign your Marcellus shale and your Utica shale to different companies, could the company that signed for the Utica drill through the Marcellus since a different company leased the Marcellus?

You most likely will not be able to negotiate a shale specific lease, however you should insist on a depth pugh clause. This will prevent the operator from drilling to a deeper depth a some later date without negotiating a new lease.
