that's where my farm is- forgive me, but what does one permit per oDNR mean? Can they still drill if it is farmed out for soybeans and corn? alternating

JODI, thanks for the info.  Where did you find your reference to the above mentioned well permit?  I cannot find it on the normal ODNR weekly permit list.  NGO is National Gas, a part of The Energy Cooperative.

Hi LS
You threw in a big question. It all depends upon how the lease is written. First of all do you have the mineral rights to that land or are you leasing the farm land or surface only for farming?
Depending upon the lease language as a rule loosely speaking yes they can drill, but in most leases there is a clause where they will pay for crop damage to the land owner. If you are the land owner the lessor then payment would be made to you if you are only leasing the surface area then youvwould have to look at that lease to see if you could ask the real landowner that had leased the property for the damage. I am not an attorney but what it all boils down to is who owns what and how a lease was written. You can go to the county recorders office and search using the property owners name to view if leases are upon the property and read them/ have the records even copied for your review.
