I got a phone message from an XTO rep about a right of way for widening the township road that abuts my property. The turn in the road is next to a very small portion of my property line; I actually thought the line ended before the turn started, so I seriously doubt they're talking about more than a few feet. Nonetheless, I want to be informed before I return the call! Does the company pay for a small right of way for road widening? If so, how much should I expect? They plan to start in March.

No they take it twp has 30 ft..right of way. They take my trees 5,6 feet road front .then they black top it. On Grape Hollow rd ..and theirs nothing you can do........I think he said 22ft for the road...
a twp has right of away for whats granted to them some is 12ft some 14ft some 15ft, you can protest it if you are losing somthing and getting nothing like i said one part of the farm is 15ft other part is 12ft its in the easment or right of away deads whats granted to them
i live on a twp road in the 1940s they changed the way the road went, owner protested it in court so they took the full 15ft on each side from the center, so they took 30ft of the hay feild over 200ft long, the neighbor had the right to make them cut or trim our road trees for his truck traffic 20 years ago
Hello,
Deed states owner of a property next to mine, was allowed to use a foot path next to the onion patch back in 1902 as stated in 1902. Can he now have it surveyed in to his title and change it to a 14 right-of-way. Alhough there is no referance in my title, just his. Strange!
if its in your deed yes we have a dead that lets us, use the neighbors land for access to harvest crops only , that was added in the 1900s, its still binding, the county court and the town ships do the roads, they took over 200ft 30ft wide hay field for 1 home in the 1940s for the neighbor that had a road to it, the township took the max over the owners protest
willam i really dont know how that works, but sounds like its access added in the deed granted by the old owners of the land , todays courts could see a foot path access now could mean the width of car ,for right of access, if he was land locked he could use that at any time for access
The property is land locked, but he owns the 42 acres that is attached to it, and has access to it from the road on next to that property. The ten acres is only 100 yards from the road, which he can acess through his 42 acres that can can walk to. Seems to me he is just being a pain in my wallet.
The landman stopped by today and showed me the piece of land they need to use for widening the road. In the unlikely event that it may affect two young walnut trees I have, they will transplant or replace the trees. Plus, they need to remove a few pine trees (that are half-dead already) and some brush from the hillside, and will pay two thousand dollars for that. I'm happy........

AboutWhat makes this site so great? Well, I think it's the fact that, quite frankly, we all have a lot at stake in this thing they call shale. But beyond that, this site is made up of individuals who have worked hard for that little yard we call home. Or, that farm on which blood, sweat and tears have fallen. [ Read More ] |
