Jack, my nieghbors recently sold a ROW to Chesapeake to a projected well site. They told me they got 5 thousand dollars payable at $250 a year for 20 years. The ROW is practicaly in thier backyard. When they told me I was sick at how they were taken advantage of. They got a check and they told me they were not gonna cash it and that maybe that would void the agreement. I just thought, good luck with that plan.

You should get a check for your legal fees at time of signing. You have to ask for it, That was something I did for ROW agreement.
Also get a clause for any additional Taxes due to their operations to be paid by them (include the pad).
I hope you don't mind me asking for specifics, but how did you present this to them? I guess what i am asking is how exactly did you ask and at what point? I may be involved in ROw in the future. thanks in advance for the info.
I asked for the Legal Fees after they gave me their standard agreement. I knew how much lawyer would charge (called and asked), also added "Guesstimate" of my additional costs. After they agreed to it I started into my changes (addendum) to agreement.
I have decided to do this with anything they want a signature on; that I'm not absolutely sure of what it means or allows. This will include my Division Orders.
