Does anyone have opinions about the Mt Jackson group that has formed in the northern beaver/southern lawrence county areas? Do you think the fee structure of 5% commission for a paid up lease is a bit much? If you have 100 to 200 acres, it can be quite a bit!

I've been told the group is closed now.  And that they are in the bidding process with prospective buyers of leases.  I also was told that a 2nd phase of Mt Jackson group has been opened and that anyone may join that, interestingly though the terms are much worse...they now want 8% of the bonus and 5% of the royalties.  Not sure if its worth those terms...quess it depends on what bonus and royality they can negoitiate.  Another way to look at it is they are either getting very greedy....or they DON'T think they can get significantly higher bonus and royality from their negotiating efforts.....just a thought....any other thoughts on the group??

BRADYS RUN PARK SIGNED UP WITH THEM, AND CHESAPEAKE REFUSED TO COME TO THE QUARTERLY MEETING TO DISCUSS A DEALING PRICE. ASK THE 'GROUP' ABOUT PROGRESS- THEY CAN'T POINT TO ANY BECAUSE CHESAPEAKE REFUSES TO PLAY BALL- AND MEANWHILE THEY KEEP RASING COMMISSIONS. IF YOU DON'T BELIEVE THAT CHESAPEAKE IS SERIOUS ABOUT LEAVING PEOPLE OUT JUST LOOK AT THEIR MOST RECENT UNITIZATION- THERE IS A BIG DONUT HOLE WHERE A LANDOWNER WAS ASKING CRAZY MONEY- THEY LEFT HIM OUT. INCIDENTALLY, ALTHOUGH STATE LAW SAYS THEY CAN NOT DRILL WITHIN 200 FEET OF YOUR PROPERTY- DRILLERS CAN, AND DO, TAKE GAS FROM AS FAR AWAY AS 800 FEET. THIS IS DUE TO THE LAW OF CAPTURE, AND THE FACT THAT FRACKED GAS JUST FLOWS TO FILL A VOID -ANY VOID- THE LESSON: GET ON BOARD WHILE YOU CAN AND SECURE A DEAL OR BE LEFT BEHIND AND LOSE YOUR GAS.

CHK just signed a deal with Co-eXprise members at prices and terms better than what they had been offering independent landowners. The lease is much better than most people would have ever gotten on their own.

I would be careful of only looking at the dollar amount for royalty and bonus payments.  Although those are very important factors to consider when deciding whether to lease, there are other factors you must take into consideration.  Remember the lease is written to protect the oil company, not the landowner or mineral rights owner.  Also, there are a number of clauses and provisions that should and must be included in addendums that will protect your current and future interests.

Landowner groups are great, but realize that your needs may not be identical to your neighbors.  Your lease should be catered to you specifically.  There are attorneys out there who are dedicated to the landowner from start to finish.   I wish I could give you specifics, but this site is not the right forum.  You should google those who handle marcellus disputes.

Like I said in my post, the landowners got better terms than they would have received negotiating individually. As a group, they had the power to get a lease that with a large number of addendums that gas companies usually don't accept. 

 

I know many people who tried to work out a lease with gas companies and they had a difficult time as O & G's are very difficult to deal with.  They will give on a few issues, like gas storage, but not on ones that really matter.

 

Groups give you leverage. And many groups will allow for an individual situation should your circumstances require such.
