had a land man from Legacy Abstracting interested in leasing my mineral rights come to my door yesterday.  Does anyone know anything about this company?  He said they wanted to drill for natural gas.  Any information would be appreciated. thanks  Donna H.

Seems odd, since Guernsey county is mostly OIL. If they were looking for ng. they would go to Belmont or Monroe counties. Maybe they think if they don't mention the oil, they can pay you less$$$ for it? You gotta watch em! Price of oil is inching up to where they can soon make profits from it.

Land man back to drop off copy of lease.  Found out it is Ascent who wants to by my lease.

Madison township Winterset area.

That makes more sense. That area is leading the state in "best oil producing wells". And Ascent is the producer on most of them. They like to use land Co.s to do their bidding.

Call around. other companies are leasing in Guernsey. I posted this to someone else in another forum for Guernsey but DO NOT, in my humble opinion, accept a delay rental. That is they offer you some $/acre and then pay you 1/5th of that price each year for the next 5 years. Call around and find out who is operating in the county and then call them. Make them compete to pay you the best price, the full $/acre for the 5 year lease UP FRONT, DAY ONE. Good luck!

     I'm betting he will want you to sign a "little something" so he can Abstractly own a lease on your land to sell to a real drilling company.

He probably operates out of the kitchen table in his 5th wheel trailer. If he works for a Real company, it won't be legitimate since they will be stealing what is yours.

People who come to your door have a plan, and so far those people didn't include the landowners in the plans they have. Don't sign until someone reads the contract and understands what you will be signing away.

Your signature always commits you to something, or gives away something of value. It not something to be given lightly, ever.

    For those of you in Ohio's latest "Promised Land", don't forget the below law from the Ohio Revised Code.

I doubt that those who will be trying to get your signatures on bad contracts are aware that it's a Felony to use fraud in order to encumber your property in a way that you didn't intend. "You are an Adult" as they say, "You signed it". But in this case your signature doesn't count, like when you are conned by O&G people.

You'll need to use a lawyer to get out of this one since our state officials don't take action against oil and gas "people".

2913.43 Securing writings by deception.

(A) No person, by deception, shall cause another to execute any writing that disposes of or encumbers property, or by which a pecuniary obligation is incurred.

[Definition: pecuniary obligation - an obligation having to do with money]

(B)

(1) Whoever violates this section is guilty of securing writings by deception.

(2) Except as otherwise provided in this division or division (B)(3) of this section, securing writings by deception is a misdemeanor of the first degree.

If the value of the property or the obligation involved is one thousand dollars or more and less than seven thousand five hundred dollars, securing writings by deception is a felony of the fifth degree.

If the value of the property or the obligation involved is seven thousand five hundred dollars or more and is less than one hundred fifty thousand dollars, securing writings by deception is a felony of the fourth degree.

If the value of the property or the obligation involved is one hundred fifty thousand dollars or more, securing writings by deception is a felony of the third degree.

(3) If the victim of the offense is an elderly person , disabled adult, active duty service member, or spouse of an active duty service member, division (B)(3) of this section applies.

Except as otherwise provided in division (B)(3) of this section, securing writings by deception is a felony of the fifth degree.

If the value of the property or obligation involved is one thousand dollars or more and is less than seven thousand five hundred dollars, securing writings by deception is a felony of the fourth degree.

If the value of the property or obligation involved is seven thousand five hundred dollars or more and is less than thirty-seven thousand five hundred dollars, securing writings by deception is a felony of the third degree.

If the value of the property or obligation involved is thirty-seven thousand five hundred dollars or more, securing writings by deception is a felony of the second degree.
