Has anyone else had this happen? The title to my property had no deficits (according to the Cambridge Office). I called Amegy bank today to see when the check would be sent and I was told that it was “cancelled per land department directive”.
I called Shell in Cambridge and they have no idea what is going on. Any thoughts?

My neighbors exp.date was 04/20. draft cancelled. Holland told them 10 days. NOW, 6 days later, they called them and said 3 weeks! So dont count on the 10 day thing. there are folks who ARE getting their $$$ from Shell. They just clam up when they get their $$$, maybe afraid of robberies?

I have been watching this site now for quite a few months to keep up with Local oil/gas info. Like many other people here in the area I'm now in the same boat as pretty much everyone else with "canceled by land department directive". The way that sounds is Holland canceled our draft. Should also remind you my mineral rights are present and VALID and have suposedly sat in Houston for over a month now with no payment being made. Ive heard the term "cold drafting" before and all of us still waiting payment it sounds like we fit that bill to the T. SO what binding arbitration do we have at this point? Lease is invalid (past 120 days) and banking draft is now invalid. So what protection is there for us landowners at this point? Not to mention all of our leases was filed with the recorders office in November 2011. Without payment should I mention. Dont know how easy a "surrender" will be if I decided I wanted to leave to goto another company but who wants to wait another 6 months? Not me for sure, but the Landowners of Guernsey county need to stand up and band together to get some answers from Shell and the Holland Services department minus all the run around answers we've all got way to many times.
-we signed with shell the first day at southeastern equipment off of 40. there was not anything that said anything about "banking days" on our contract ANYWHERE on it.
In Feb, 5 days before the 120 days where up I called to check on progress. Holland informed me that by the end of the five days I would either have a defect letter or money.
That was the first lie they told me, I don't have fingers and toes to count the lies I've been told by them since then. They have told me that I would be paid in two or three weeks about 4 times now. I understand that it was has been crazy at the recorders office but the lying and acting like they don't know what their doing makes me very uncomfortable with the bunch at Holland and shell.
we have been verbally informed that our mineral rights cleared, they called us in to sign another contract because of a couple of lines not filled out. Bruce at Holland told us that the turn around time would be about 3 weeks, well we're there, and nothing. We live in section 2 of wills and I have a contract for $5,900 per acre and 19% royalties. It was not the land owners contract I assume since it was sent to me directly by anterro. I know a bird in the hand is worth two in the bush, but this is looking more tempting everyday. anyone want to throw their two cents worth in?

Im sure your not the only one with a long fairy tale of lies being told by Holland, Im in that same boat with you. The problem is 1 voice, 2, 3, 10 voices wont fix anything. Maybe some bad publicity in the local newspaper and a few calls to the Ohio Attorney General's Consumer Fraud Divison might fix something? (hint...hint) If we all banded together like we did when we joined this land group, and band together as one voice to make our problems well known to the unknown persons, then MAYBE and only MAYBE will our monies become due to all of us! All sounds like we've got a good headstart on a class action suit...any attorney's want to work Pro bono? lol...since we dont have any money.
Where's OUR MONEY, I was thinking the same thing. Some bad publicity in The Daily Jeff couldn't hurt. It was front page headlines when everyone was standing in line for the Shell signing back in September if I remember correctly. Sounds like some people will have a long road a head of them to get thier money. Maybe in a month from now things will turn around!
I'm really hoping it doesn't come to that.
we heard that shell Pennsylvania had run out of money and had to go to shell Texas for cash. I do think that asking for a release gets their attention.

Were you represented by an attorney during the leasing process? If so, what does he/she advise? I think that it would be best to contact and oil and gas attorney to advise you through this process. The bank where I took my draft to has one on staff. Perhaps your bank has one you could consult free of charge. I read on a post from Tom that Amegy Bank told him his draft would be paid in 10 days. Did Amegy tell you something similar or did they tell you that your draft was cancelled? Sorry to ask so many questions, just trying to help resolve. I hold a shell draft also. Not through Holland though....
I really don't think it would be wise to go to the press with this. You want your money, it looks like they intend to honor your lease, they just haven't paid. The trick is to get them to pay you or give you a firm date as to when you will be paid. I am sure this has happend before, and there is an optimal way to resolve. They need to be honest with you and tell you what exactly is the hold up on payment is and how can it best be resolved. I agree with the post that people that have been paid are not on here.
Mark this does not look like a isolated incident. Surely by now Shell has had enough complaints they know they have a problem. I do think it is time to get a reporter on this. After all if I were Shell I'd much rather talk to a reporter get it straightened out rather than see a bunch of irate land owners file a class action law suit! You might also consider there is still a lot of land to be leased in the Utica and bad PR is not conducive to acquiring new leases.
Couldnt have said it better myself. All we need is some simple answers and NO more waiting games or runaround about our banking drafts, incorrect paperwork etc. IF your title cleared and passed due dillengence it is simple..PAY US! The media outlets would surely pickup a story of this magnitude for all the money that hasnt been paid thats still out there. Last contact made by shell to me was February 24. Every contact made after that has been made by myself. No denial letter, not a peep. Other than "its in texas...we dont know how long its gonna be. How do you loose all this money? I cant figure it out? Can anyone else. Plenty of TV reporters, news papers, etc. out there..maybe they can figure it out? Or let the rest of the General public figure it out?
Billy, You may be right, I just don't know what the optimal way to resolve. Is Holland a leasing agency? I know Shell contracts different agencies to lease. Are these problems the fault of the leasing agency or Shell corporate? Perhaps if it is the leasing agency, Shell corporate needs to be informed. I signed with Shell also, through another office. A few hours on the phone to Shell corporate might provide some insight. Ask Holland for contact number at Shell. I appreciate your sharing info so that we can avoid problems when our drafts our due. As I mention earlier, I would contact a competant oIl and gas attorney who has been through this, to help resolve.
Mark what kind of Trick? Why should there be any tricks with the amount of money that we are all dealing with? Your exactly right, they need to pay. It has been impossible for me to get a firm date from them, and all they can say is they are not sure when its gonna come through, last phone call to holland today was "possibly" a couple of weeks. Doesnt sound fair to me. Ive been very patient with the whole process, understanding I dont have a large tract of land to offer, but SHELL leased me. Their reps signed my lease, offered me the banking draft, and offered us all the intention that if our land was a clear title with mineral rights we would be paid.
