Can anyone tell me what "james fork, Lincoln district and Dunkard Mill run, Lincoln District" Marion county Mean? This is all new to me and I`m in PA.

As far as I understand it, the counties in WV are broken up into districts. Lincoln happens to be a district in Marion county and I know it covers part of Mannington but not sure if it stretches into any other towns. James Fork & Dunkard Mill run sound like the roads that it might be starting and ending at. If you google "James Fork Road, Mannington" it may bring the area right up on the map for you. Also you can go into Marion County clerk records (online) and see the tax records. You can choose Lincoln district, and James Fork or Dunkard Mill and it will give you a list of addresses and names on that road.

And then on the left side, click on "search your tax records". These are the search fields that will pop up. Click on "Enter district, map, parcel," and there's a drop down box arrow that will allow you to choose "Lincoln District". Unfortunately when I typed that in, it gives a list but not a complete list of properties. It says "too many matches". If you have the parcel #, lot#, etc. That helps narrow the search and makes it easier to find.

Lisa's right about everything except one thing. James Fork and Dunkard Mill Run are the names of creeks. There may be corresponding roads, but you can't count on that. I expect you got "James Fork, Lincoln District" and "Dunkard Mill Run, Lincoln District" from a legal description of the property or from the tax ticket, right?
BTW, that's a lot of useful information Lisa looked up for you. You don't see somebody going above and beyond like that every day.

It's funny that you replied with that because I just learned yesterday that our property is surrounded by 3 "runs" and all 3 are polluted with Ecoli (according to the EPA). We are not sure which one feeds our well but we have the county health dept coming out because......you guessed it......we tested for Ecoli in our well! Once they start drilling for Marcellus on our road, will the water be ruined forever? I can't imagine that all this water pollution created by the drlling companies is okay with the EPA/DEP and the rest of the world. What are we going to do with all that gas when we die of thirst because nobody can drink the water???? Hmmmmmm..............

Do you mean that there's Ecoli in your well, or that you just had it tested to see if there is?
Regardless, since you have surface, here's my recommendation to all my surface owners: 1) get water tested so you have a baseline, or at least get a sample and store it; 2) take lots of pictures (lots and lots) before any activity starts on or near your land; and 3) keep a journal of all oil and gas events. It's never too late to do any of those.
Yeah, the water pollution is a problem. You hear lots of stories about wells getting ruined because of fracing. Trouble is, very few of those stories include any proof of what the water source was like before the drilling. The stories you don't hear are the ones where there is proof of what the water was like, and they settle with the oil and gas companies - when they settle, they agree not to talk about it. I think fracing does cause bad wells, but it's very difficult to prove.

Studies show that water could have been contaminated before drilling. What you need to do is have a water testing clause put in your lease, this will make the company test the water before drilling, in the middle of drilling and the finish of the well.
