The Fenner # 1 (it wasn't 1H) was a shallow well permitted by M&M in an attempt to force the OGM owner to grant them a lease extension. They were signalling that they would rush to drill a shallow well before their existing lease expired if the owner didn't give them the extension they wanted, and the threat did the trick. They never intended to actually drill there.
