I have a question regarding the rights or lack thereof that a surface owner would have if they bought property without the OGMs. My wife and I are rather new to the area and unfortunately missed the boat to buy land with rights. Now as we all know if you want the rights you have to pay outrageous prices, and we would really just like some acreage to farm and hunt.  Plus with my forestry and logging operation I would like a shop and room for equipment. My fear is that if we bought ground without rights we wouldn't have much say in whether we get drilled on and so forth. Dont really want to put the effort into building barns, improving pastures and so forth just to lose it all. Not opposed to the drilling but would like to know that with paying a mortgage and paying the taxes we would have some say. Anyone on here run into any of these issues yet. We are trying to learn as much as we can before we commit to buying. Also curious what is covered by oil, gas, and mineral rights. The rush is obviously for the gas, I've heard rumors about oil, but does this cover them for full-fledged mining too? That would be a real turnoff for us.

The best thing you can do is to get a copy of the lease and see if there are any restrictions in it to cover your concerns. If there are no restrictions of what they can and cant do. They pretty much have a free reign....
You'd have to look at the lease, but many stipulate that drilling has to be a certain distance from any structures. From what I've seen, most companies are doing a pretty good job of reclaiming the land (that should be in the lease, too...set aside topsoil, regrade, etc). But I still don't think I'd want a drilling operation on my land if I wasn't going to benefit from it.
